- The New Jersey State Supreme Court on Friday rejected an appeal from prosecutors in Rabbi Osher Eisemann’s case to overturn Judge Joseph Paone’s ruling for a new trial. Prosecutors now must make the decision whether to attempt to prosecute Rabbi Eisemann again in a new trial – this time will all the evidence clearly showing that the SCHI founder had committed no wrongdoing. While this is likely the end of the road for prosecutors bent on sending an innocent man to prison, it isn’t yet known whether they will attempt to retry him. - Two more soldiers killed during fighting in the Gaza Strip on, bringing the death toll in the ground offensive against Hamas to 58. They are: Captain Roey Biber hyd, 28, from Tzur Menashe, and Sergeant Binyamin Meir Airly HYD, 21 from Beit Shemesh

- Washington Post is reporting that Israel and Hamas reached a tentative US-brokered deal to pause fighting for 5 days and Hamas will free women and children hostages. Under the terms of a detailed, six-page agreement, all parties to the conflict would freeze combat operations for at least five days while an initial 50 or more hostages are released in smaller batches every 24 hours. It was not immediately clear how many of the 239 people believed to be in captivity in Gaza would be released under the deal."

Prof. T. wrote in an email that the state brief does not respond at all to many of our complaints about the remand process, why a "comprehensive review" that was ordered by the acting commissioner on July 16, 2021, and ordered by her to be "expedited" on May 12, 2023, is only now beginning; or why the multiple state monitors' statutorily required weekly reports to the commissioner or designee have not provided whatever updating information the acting commissioner might need to respond to the remand question about SFRA's unconstitutionality as applied to Lakewood; or why anyone should take solace from another $93 million repayable loan to a district long ago overburdened by loans (according to the ALJ, saddled with "an unsustainable fiscal burden"); or why eight annual certifications by a series of commissioners, including the current acting commissioner, required to support the loans, which state that, without the loans, Lakewood has insufficient funding to provide T&E, don't by themselves establish that SFRA is unconstitutional as applied to Lakewood.

  4. The mistake at law, and as usual he found it before me, was that the AG brief clearly misstates New Jersey law on the application of R. 1:10-3. Several times on page 14 the DAG (deputy) indicates that, to prevail on our motion in aid of litigants’ rights, appellants must prove that the acting commissioner has acted “willfully” in failing to comply with the Appellate Division’s remand order. He stated it most pointedly in the last full sentence on that page (“Thus, in order for the court to grant appellants’ motion, there must be a finding that the Commissioner has failed to live up to this court’s remand instructions, and that she has done so willfully.”)(Emphasis added.).

    He derived that supposed rule of law from three dissenting opinions in Abbott, where, of course, the majority or plurality granted the motions in aid of litigants’ rights. He also ignored a later New Jersey Supreme Court opinion in In the Matter of the Adoption of N.J.A.C. 5:96 and 5:97 by the New Jersey Council on Affordable Housing, 222 N.J. 1 (2015), a rather well-known opinion to say the least.

    In that opinion, the Court has a substantial discussion of R. 1:10-3 at pages 17-20. Most pointedly to our case, and the pending motion his brief addresses, the Court distinguishes between a motion based on civil contempt where a “demonstration of a mens rea, wilful [sic] disobedience and lack of concern for the order of the court is necessary,” and the irrelevance of such a demonstration where the movant is seeking “simply to enforce a judgment on a litigant’s behalf,” in this case the court’s remand order.

    The Court puts an even finer point on that view when it refers to a much earlier Supreme Court decision in N.J. Dept. of Health v. Roselle, 34 N.J. 331, 347 (1961) and the following language cited there: “The Appellate Division correctly held that upon a litigant’s application for enforcement of an injunctive order, relief should not be refused merely because the violation was not willful.”

    The Court explains the basis of that rule in the following terms, clearly applicable to our case:

    …[O]ur court rules generally are to be construed and applied to secure a just determination and to achieve simplicity in procedure. R. 1:1-2. That admonition has particular force when it comes to assisting a litigant in securing vindication of rights.
    The Court Rules overall evince an intent toward flexibility when the enforcement of rights is at stake. They provide various means for securing relief and allow for judicial discretion in fashioning relief to litigants when a party does not comply with a judgment or order.

    That is from the good professor. The rest is from me.

    It is a REAL SHAME that the Court rules do not allow a reply brief or oral argument.

    TEN YEARS NOW AND WE ARE STILL PLAYING THESE GAMES!!!

    They don't answer ANYTHING of content and mistake rules of law.

    My petitioners, the parents and children of Lakewood public schools and nonpublic schools get the same incompetent nonsense from the BOE (and their client) as from the AG (and his client).

  5. Biden will be reelected if he gets and immigration bill. He can get Republicans on that without crossing Trump. Country will be in safe hands.

    Biden just got China back on our side. Also (1) US and China resumes middle level direct military communication which was better than we had with the Soviets and (2) crackdown on Chinese companies making the key ingredient in fentanyl.

    Xi is a chemical engineer. They say he reads everything, after hours, family man. In a way, he sees Biden as a mentor. Xi set China's goal is to equal the United States by 2050. Problem is that the one baby policy made China country of mamas boys. And the China army's last fight was killing their own people under Deng. Plus their new jet engines are at best (not) equal the the US engines in 1990s.

    The US today leads in every industry, including the very important communications industry exporting the American way to the world. Every one wants to be free, buy American intellectual property, the arts and sciences, and just stuff, much better than China stuff.

    China wants us to leave them alone and just trade, which is a wise policy. They are an ancient country without history of a distant war.

    The weapons on Taiwan are like those the world sees now in the Israel war and the Russian war. The weapons are fearsome, not like the world has seen before.

    People who say it was once better, better be ready to steer this country wisely and justly in China relations in what Bidden just accomplished. Learn from Kissinger.

    The country made the same mistake throwing George H.W. Bush out. The US got weaker since then until now. Biden has wielded American might wisely. He's got Russia on the run, he's taking a righteous and firm stand in favor of Israel, and he made peace again with China .

Just a fifth generation old Democrat who has seen many administrations and America get involved in wars, and the four letter word "lose" (I hate saying that word), too many times, in wars that were not necessary at all like Viet Nam (Democrat) and second Iraq war (Republican). Fortunately, China has no soldiers or officers with combat experience, the middle class does not want to fight when they can make money, and China is still a VERY distant second place. Even if Trump is elected, Congress should not allow him to dismantle the national security structure that has brought us preeminence, and kept us in first place, in a very dangerous world.

    As for terrible facts, you are right. Inflation destroyed every president, despite the infrastructure and the Build Back Better law that will keep America on top of the new technology, but as they say, "It's the economy, stupid!" Shame because Americans NEVER vote on foreign policy. Look at the folly of Wilson that though he could get the public on his side against the Senate in 1920. Shame, again but American never really worried about events outside its own shores, protected by the two greatest oceans and protected by the mightiest navy since the world power war machine created by Mr. Pepys.

    2. I would say that Clinton, who was much more conservative than any Republican now, working with Gingrich messed up with the lifetime ban in the super conservative 1995 or 96 law. That is why the migrants don't go home. If Biden can fix that he will be reelected. We have to fix immigration. We already are the most powerful country. We have to have a fair and just immigration law.
