Prosecutors Appeal Case

Prosecutors today filed an interlocutory appeal of Judge Joseph Paone’s decision to permit a new trial in the case of SCHI founder Rabbi Osher Eisemann.

An interlocutory appeal – also known as an interim appeal – occurs when a ruling by a trial court is appealed while other aspects of the case are still proceeding. Interlocutory appeals are allowed only under specific circumstances, which are laid down by the federal and the separate state courts.

In this case, the appeal’s significance is that it does not appeal the final case judgment, but rather a specific ruling in the ongoing case.

Those close to the case related that it is not yet clear if the judge will push off the new trial during the interlocutory appeal or if he will proceed with the retrial.
