ReplyDeleteWhat a disgrace? Once I again I have to go after the commissioner because of the lack of leadership. Why did the BOE abdicate its duty to the NONPUBLIC student by referring all questions of transportation to the LSTA. That's all you get in an OPRA request.
From now on there will be transparency where officials will actually answer to someone asking for redress. IY"H there will be regular public meetings of an oversight committee. Even better, maybe the BOE will begin to do its job. A Lang

I worked on this for a year and half. Bais Din, what cause of action, what is the harm, taking from one and giving to another, not revealing identity of my client, are there constitutional and due process considerations, is there tangible harm by how the LSTA makes the routes (then they for sure would have to be avdefendant)?
DeleteFinally I figured it out. If there is an oversight committee open to the public, everyone gains. Grievances will be addressed. Who gets what will be decided transparently.
If I file for a writ of mandamus, which I did, then the case law is more lenient about revealing the Plaintiff's identity. Bais Din was not a problem since the LSTA was a permissive defendant. They had nothing to lose. They were not necessary. However, by naming them I could get discovery and who knows, they might have had an interest. I did not want to take a chance on the state dismissing because they were not named. They did that in 2014 when I did not name the4 BOE as a defendant. This might be different but I won on that motion when it was decided in 2015.
Their lawyer called me to say that they are not against the oversight committee but don't want to waste whatever money the LSTA has left over buy answering the complaint. That solved the B"D problem for good. I took their name off. They promised that they will cooperate with discovery for whatever I need.
A writ of mandamus (think Marbury v Madison, to compel Jefferson to give man Adams appointment his government job) is when a court compels a government official to do his duty. The Commissioner, by law, needs to establish the committee. Everyone says they have such committee but I don't think it has met in years, never knew what to do. I consulted with the teachers union president who was on the committee and she said as far as she knows, it no longer exists.
Once this is on the front page of the newspapers, the public hopefully will pressure the committee for transparency. I certainly will in court.
