Of course a state does not have standing as to how another state picks its electors.
ReplyDeleteOnce again, Republican attempt for judicial activism. I do believe that Republicans are bigger judicial activist than Democrats. Earl Warren was appointed by Eisenhauer. Frankfurter, the most exemplary justice of retrain was appointed by FDR.
Court are not for writing mew laws or acting a political body like in Roe v Wade, Lawrence v. Texas, Miranda or even Lochner v. New York. Why is it that people run to the Court whenever they lose in the political process? Republicans that show their split-hoof like the chazer claiming to be against judicial activism when they are the worse when it comes to their causes.
As for Alito and Thomas (Thomas a great activist wanting to incorporate more and more into federal jurisdiction to overturn the will of the people by expanding the 14th amendment like saying the 2nd amendment applies to the states, eminent domain, which I agree with his position if it were really a federal question but unfortunately John Marshal in Baron v. Baltimore in 1830 said differently, alas though, the Warren Court made it a federal question, again expanding the law as activists, so he has a point accordingly) would never have allowed the case to be hear on the merits, as ridiculous as it was. They only said that they would have allow it the parties to file, a technical issue.

DeleteHow did he win? The electors are already certified and will cast their votes on Monday. The if a Representative or Senator from the same state contest the result of their state, the whole Congress takes a vote by head, not by delegation. How can you say he won?
