BDE: Petirah of Mrs. Chaya Dina Brus a”h (nee Spector) of Bensinhurst following an illness. She was 49. Her husband R’ Yeshaya z”l  was niftar a little over a month ago they leave over 7 yesomim. The Levaya will be in Brooklyn this morning at  10:00 AM, with a levaya and kevurah in Lakewood at 12:00 pm

  4. I dont know the story with the person with the cops. The cops are not beyond the law and I hope the person has a lawsuit against the cops. they have no right to be in the property without a warrant.

    1. I'm no lawyer but as far as I know the Supreme court ruling (Horton v. California) that the police don't need a warrant to enter your property if the evidence seems to be in "plain view" would probably apply in this case . Meaning if they see something suspicious on your porch (like this case) they are allowed to come onto the porch to investigate without a warrant.

    3. I am also not a lawyer, but the plain view doctrine requires the police to be at the location legally and he ordered them off his property.
      They also are not allowed to further inspect the item (Arizona vs Hicks), if it isn't obvious from the plain view, which if you watch the video, they are doing exactly that. They basically fail on at least two prongs to justify Horton
