For those that disparage our state, be aware that there is no First Amendment right to free speech on private property. Under the NJ constitution, there is. In two cases, freedom of speech was applied to private property, Princeton University and shopping malls. “[T]he more private property is devoted to public use, the more it must accommodate the rights which inhere in individual members of the general public who use that property.” State v. Schmid, 84 N.J. 535, 562 (N.J. 1980). I do not think the NJ Court would apply its law to something so clearly under the control of Congress. The Article I, Section 8, interstate power of Congress “to regulate . . . excludes, necessarily, the action of all others that would perform the same operation on the same thing." Gibbons v. Ogden, 22 U.S. 1, 209 (1824) (The Gibbons case created the American economy).
