- A powerful 7.8 magnitude earthquake hit southern Turkey and northern Syria early Monday, toppling buildings and triggering a frantic search for survivors in the rubble in cities and towns across the area.     1. The letter doesn't really help. Anybody can call himself 3 dayanim and even mean well and even know a bit of halacha but if they don't have a glatkeit in understanding the business world ,the outcome may not be exactly right. And unfortunately this is not theoretical.

  10. There is a crisis in Bais Din. It used to be an ehrliche yid went to Bais Din to know the halacha; today they go to win and often by any means. With no power of enforcement to deal with these baalei din the best are not going into dayanus because it is an exercise in frustration. No one with any experience in bais din, negotiation, arbitration call it what you will wilI agree to the process without getting signatures on a shtar birurin, I often advise baalei din that the most expeditious path is to find someone that both sides respect and will listen to. and yes this is halacha. What this letter really is, is a battle between the (not so honorable in these cases) Rabbi and Batei din in Lakewood who have ruled against his talmidim. The Rabbi having not sat in on the sessions of Bais Din automatically sides with his talmidim (shades of someone else we knew) and begins undermining the Bais Din, and with this letter the Bais Din process. The claim here that people go to a "person" for arbitration is a thinly veiled attack against Batei Din.

    1. Your facts are not totally accurate.
      Most Dinei Torah end up with a psak that the Ba'alei Din listen to and accept. They may feel that they could have done better, but they don't deny that the Beis Din are professionals. The Batei Din in Lakewood that are respected by the Talmidei Chachamim of Lakewood, such as Maysharim and Bais Hava'ad, do such a job. The Dayanim were known for their knowledge before they became Dayanim, and even if one or two of them are not as great as the others, the actual Bais Din is accepted. No Rav will ignore a Siruv from them.

      However, there are some opportunists who hang up a shingle as a Beis Din with no backing whatsoever. People who learned very little but enjoy being part of the hock. Ba'alei Din can think they are getting a better deal with these mavericks, but they don't know that these Batei Din are not respected anywhere, their siruvs do not move anyone and the Rabbanim routinely ignore their hazmanos and decisions. They have to be stopped before they trick more innocent people into spending money for a hazmana that is useless.

    5. Professional means they meet the standards of the profession. In Dayanus that includes, knowledge, ehrlichkeit, understanding, open-mindedness, yashrus and impartiality. In plumbing the list would be different.

      I often speak to Dayanim and they explain the rationale behind various pesakim (matters that I am not involved in). The Ba'alei Din cannot imagine how many details enter the sugya, and when they complain about the pesak it is obvious that they do not have the slightest clue as to the basis of the pesak. Don't trust Ba'alei Din's complaints, they are often based on basic ignorance.

    6. The one thing that is not always taken into consideration is a good understanding of the relevant business practices which are much more complicated today than they ever were . Many years ago, a lot of chosuve botei fin even took a bal habis a yidea sefer who was a pikeach in business as one of the borrrerim,to make sure that the business angle of the case was made clear to them .Today with tge complications of 200 page contracts and LLC ,corporations and many new types of business practices ,the understanding of the business details , the parties intentions based on the complicated contract terms , etc etc is not always clearly understood by every yunger man that learned chosen mishpot .

Rather than the incessant promotion broadcasting about their shades professionalism which has become a sine qua non, they would develop common sincerity and decency and a larger view than they are capable of - which is more likely to be found among those they need to bash dash -who won't much expend as much cultivating the show of professionalism and polish,the public might actually take the previous comments with a tad more sarcasm than an advertising piece
