Trial Update: Seder Limud and Minyan for Tehillim today

The NJ Attorney Generals office said today in statement it was reviewing the judge's decision and considering an appeal.

-4:50 pm: Judge issues Sentence: 2 YEARS PROBATION, 60 days prison in Middlesex county jail (Starting July 1st/ 28 Sivan) and a quarter million dollar fine. Rabbi Eisemann is allowed to return to lead SCHI but can't handle the finances. Members in the audience have tears streaming down their face standing next to R' Eisemann.


-4:45 pm: Judge Says never saw such overwhelming support from the letters he received on behalf of Rabbi Eisemann  (APP)
-4:20 pm: Judge begins his ruling spelling out different legal parameters of  what he can sentence reading verdict  (osher ben Chana Frumet)
- 4:15 pm: State argues he is a educator builder, nurturer but not a victim he lead a great life but that does not exempt you from the law

-4:10 pm: R' Eisemann speaks- asks for rachmanus so he can help abd care for his soecial needs son and continue his life's work at SCHI. I'm sorry the last 3 years have distracted me from my mission that i loved outside if my family. My son Eliezer has been a great blessing to my family but not all blessings are easy.
-4:00 pm: Defense attorney pleads with judge for the sake of the Rabbi's family  special needs son a student at schi.
-3:58 pm: State asking judge to sentence to 12 years in prison (charge is usually 5-10)
-3:55 pm: GL confirms Rabbi Eisemann will speak prior to sentencing
-3:50 pm: Judge asks if probation sentence will send a message to not loan out schi money says he hasn't acknowledged ha can not do so
-3:45 pm: Defense lawyer says judge should disregard prison because if R Eisemanns good character, money was repaid in 12 days and no harm was done to the school. He built that school from a strip mall. But can't Go back Convictions will prevent him from working at schi (app)
-3:35 pm: Attorney Lee vartan speaks on R' Eisemann's behalf pleading with judge for a light sentence reading letters in support
-3:30 pm: Judge addresses R' Eisemann sympetheticly hoping he can see all the good he's done and this unfortunate situation should not temper his  selfless life
-3:15 pm: Judge upholds the verdict DENIES DEFENSE MOTION. NOW MOVES TO SENTENCING (APP)
-3:10 PM: Judge says the evidence for money laundering was slim but adequate enough to support jury's verdict.
-3:00 pm: Judge orders break
-2:55 pm: Prosecutor says throwing out guilty verdict would undermine the American court system that the jury is the finder of facts
-2:45 pm: Judge says ges convinced from trial all SCHI money can not be used as seen fit by any employee Public or private donations . (Via APP reporter on Twitter)
-2:00 Pm: Defense argues there is no evidence Supporting money laundering conviction. State  Deputy AG says charges should stand because he wss in charge of operations in the school.

The defense team for Rabbi Eiseman has been working on a motion to have the final two charges dismissed. Today a Judge will hear arguments from both sides  beginning at 9:00 am to 1:30 pm. In an interview with the Yated Ne'eman Pesach Edition, Lead attorney Lee Vartan  explains the procedures today.

It will begin with a hearing in which the judge will listen to final arguments from both sides whether to throw out and dismiss the case. The defense feels confident and will put forth their arguments why the two remaining counts should be dismissed. If they are successful, there is no sentencing and as they said "we go home". If the judge disagrees than they proceed to sentencing, at that point they would put forward their arguments why Rabbi  Eiseman should get probation. The state could also argue for probation but can also argue for jail time. Doing so would be disingenuous since they said a few times this is not a case deserving of jail. He explains his position, before the trial the state was willing to give a plea of probation to a third degree offense, now post trial and the jury has cleared him he has been exonerated from stealing a million dollars, there should be no way the state should come out and ask for a worse sentence.

In light of Rabbi Eisemann’s trial on Monday, There will be a special seder and minyan for tehillim concurrent with the sentence today the seder will take place at BMG Mizrach Bais Medrash until 1:10 pm followed by tehillim until 1:45 pm. Mincha will follow and than there will be a minyan that will say the entire sefer Tehillim.

  1. Can you imagine how terrible, even 60 days in jail! Our hearts cry for Rabbi Eiseman. The penalty is cruel too, but nothing like locking up a tzaddik like R Osher. He is a Korban tzibbur. We have to raise ourselves to be worthy of him being the seir la'azazel.
