      After Yisro gave Moshe advice on making the many levels to answer questions etc, Yisro said the following:
      אִם אֶת הַדָּבָר הַזֶּה תַּעֲשֶׂה וְצִוְּךָ אֱלֹקים וְיָכָלְתָּ עֲמֹד וְגַם כָּל הָעָם הַזֶּה עַל מְקֹמוֹ יָבֹא בְשָׁלוֹם:

      וְצִוְּךָ אֱלֹקים
      is an extremely important part, regardless of how well-intentioned, seemingly necessary,
      and smart the idea was. Yisro said as much and added this condition. The idea may be good, but seems to be lacking the וְצִוְּךָ אֱלֹקים, which may be why it didn't work.

  2. If Daas Torah said to do it its not a silly idea, daas Torah knows best and to question them is total kefira and apikursos.

    1. You are assuming, wrongfully so, that every opinion said on any topic, by someone labeled a gadol is "Daas Torah". That is not our mesorah.

    1. Let’s not forget the powerful רובא דליתא קמן of comments against the initiative on hefkervelt. There is also a strong חזקה אין אדם חוטא ולא לו against the initiative as well as ספק עיגון בנות ישראל לקולא. If you go through the סוגיא it’s extremely clear that there is no point in making a תקנה שאין רוב בני הפקרולט יכולים להתקיים בה. I can’t imagine why any of our גדולים would ever dream of even making such a far fetched takana. It’s absolutely unprecedented for חכמי ישראל to ever make a תקנה about anything.
