TBL: Lawsuit upheld against Lakewood allowing Zoning change without traffic Enhancements

TBL Claim "Incredibly - "it turns out that until today, Mayor Ray Coles and other  Township Committee members knew nothing about this lawsuit!!" there was one Township Committeeman who knew about it.

When the Master Plan proposed zoning changes that allowed higher density in certain zones, and allowed regular housing (instead of just senior housing) at Eagle Ridge, the changes were made contingent on
1) Significant road enhancements leading to a level C or better on the surrounding roads
2) Impact fees being enacted in the entire Lakewood

The Planning Board specifically made sure that the zoning changes would only take effect once these enhancements were made.  In early 2018, Augusta Holdings LLC filed a  lawsuit  they claim that the ordinance requiring roadway improvements, was in effect a moratorium and therefore violated their rights to use their land. They therefore requested that the restrictions placed on the zoning changes be removed. The Township Attorney sent a response on 3/15/18 saying that the Township only meant to allow the

new zoning if the trafic changes are implemented and therefore the applicant is no worse off than before the master plan.

  4. The only response was a letter? A defendant in a lawsuit has the right to oral arguments and to request a trial by jury. There is no way a jury in NJ would have ruled the same.

Those that are upset by the all too real feeling that we are disliked by groups like Rise up Ocean County need to realize it is corrupt games like this, that everybody sees , that causes this hatred. It is not baseless hatred. It may be hatred directed at the innocent bystanders instead of those causing the problems we are all experiencing. But if we simply stand by and say tsk tsk, we cannot expect outside communities to accept us with open arms and apple pies when we arrive in their towns. Our leadership, rabbi Weisberg included, is responsible for giving us a black eye in the surrounding communities, and our corrupt reputation now extends far and wide. They want to blame those that speak up about it. As if nobody else knows and sees what is going on. Those of us that speak up are at least proudly showing everyone that we are not all complicit in this corruption that is now hurting everyone.
    How ironic is it that those screaming chillul hashem the loudest are the ones responsible for causing it. They are the real bad apples. Good neighbors are not made with PR firms. They prove themselves by their good behavior and honesty. I cannot believe that it has now been over 8 years since we realized that our VAAD and other leaders are not concerned about what is best for Lakewood. Yet we still have them around and they are more brazen in their corruption even after we can see that they have ruined our quality of life and now scared our neighbors into hating us.

  6. So, is our Mayor is asleep at the wheel? Who was in charge of monitoring & directing the attorney’s activities? Who was elected to make sure the resident’s interests are protected, including at the courthouse? How many other developer lawsuits did our legal department make believe they opposed, but did not fight against, to our detriment? Why was this sham lawsuit settled so quickly in the developer’s favor, in just three months!!? This has all the markings of being rigged from the outset, and brings to mind many other similar shenanigans which have taken place ever since certain committeemen were put in power..

    And now it was also discovered that these same committeemen are contracting with a certain “Land Management Consultant” to be the gatekeeper & ripe-for-corruption private advisor for every land deal in town!? How can all this stuff happen so silently, without anyone realizing the long-term detrimental consequences to the residents??

  7. I wound up in this blog by accident after reading reviews about Bingo Supermarket. I read the comments and felt compelled to leave a note.I recently sold my home in Toms River to an Orthodox family. I left my neighborhood, not because the Orthodox were moving in, but because, unfortunately, I was getting divorced and needed to downsize. Before I sold, I found my new neighbors to be kind, friendly and family-focused. They maintained their property at the same level as the previous owners. From my standpoint, there was nothing to dislike and certainly nothing to fear. There were new faces on the block (and quite a few more minivans) but nothing else changed. I sold my house without a realtor. As a result, I met dozens of Orthodox families during the process. Two families were downright rude and made me feel uncomfortable in my own home. Besides those two, everyone was great, including the people that ultimately bought my house. I can't imagine that the ratio of rude people to pleasant people would be any different if the population looking at my house wasn't Orthodox. Every group has good and bad. I don't understand why people don't see that. I will say, however, that I did not have a great experience with the Orthodox realtors who brought clients to see my house. They pressured me to sign a contract with them even though I was adamant about selling on my own. One realtor told me - this is a direct quote - "If you sign with me, you'll get a higher price. My buyers would rather pay more and have money going to me because I'm Orthodox than have you get all the profit from your house." WHAT?!! WHO WANTS TO PAY MORE FOR A HOUSE JUST TO KEEP THE MONEY OUT OF NON-ORTHODOX HANDS? I also had my For Sale by Owner signs stolen a number of times. Did that ridiculousness make me dislike the Orthodox? No - It made me dislike realtors! I see now that so many of you are as angry about the corruption in Lakewood as those of us who are not Orthodox. I honestly didn't know that. I'm sorry to hear that so many of you are being judged for the bad actions of a few. I wish you luck in your fight against the leaders who are not serving your community properly and I hope you find joy in your new neighborhoods.
