ReplyDeleteVery good. The state had no viable argument. Lakewood is zoche to have Prof. Tractenberg representing the kids with me. The matter will go to the NJ Supreme Court, probably as of right if the panel is not unanimous, no matter who wins. You never know what the state will do though. They did not ask for certiorari on our 2023 win and the Appellate Division ruling became the law of the case.

If these tariffs work, America is no longer a preferred trading partner to all of these countries. America is the same as any other place. If that happens, much of America's ability as a superpower evaporates. Especially if the aid America distributed was stopped.

ReplyDeleteThe State wanted to say that we had have done everything possible in Lakewood to prove the formula is unconstitutional as applied. In fact, Judge Smith, who was on the 2023 panel asked why should he not defer to the Department of Education since they are the experts. Prof. T. answered that since we already got the T & E ruling (2023) and the state did not appeal it, than Lakewood has the same status as the former Abbott districts and the burden shifts. It's like the judge said, who happened to award us the victory on T & E, that we have not done everything to reduce transportation cost. There is no such thing as doing everything! Does not matter. The burden of proof should be upon the state.
ReplyDeleteAlso, the State tried to argue that the monitors really just advise. Judge asked him about veto and he agreed. We asked the Court to take judicial notice of what's been reported in the press this year about the monitor.

Y'all should have made me CEO back in 2003 when the state played the same game, that the problem was not the formula but courtesy bussing. I remember saying to everyone in the organization that courtesy bussing is just a smoke-screen. The numbers never added up. Same like now. Except now it is not courtesy bussing, but mismanagement. Same with the wealth argument that state used in 2003. It was all a side show. Doesn't matter because the state does not use the same methodology any more to calculate wealth. .
