APP: At the BOE meeting Many in the crowd booed after attorney Michael Inzelbuch refused to answer a question about his lucrative compensation. He responded 'Your article is right. I haven't spoken to you regarding your questions for more than a year. I feel your reporting is jaded. I feel your reporting is against Lakewood,' Inzelbuch said. After many in the crowd booed and yelled out in response to Inzelbuch's comment, he sought to explain.
..."the bottom line is, and this has been studied and looked at, when I was suing the district, the same numbers were coming about pretty much so the board has opted to hire me to win ... as we have," Inzelbuch continued. App

Why is every site making sure to let everyone know that playa bowls isn't CY. I didn't see this level of frumkeit when Ritas opened, also serving non CY products. It's someone afraid of the competition?
ReplyDeleteBesides, the fact that a store in ihr hatora of Lakewood, owned by a "Rabbi", to serve non CY, it's nothing short of a shanda. Playa however is owned by a non jew.
When did Ritas open? You mean when they were bought out? There were plenty of talk to what their locations were serving CY etc. Just because you are upset (for unknown reasons) that there is a psa about CY at Playa doesn't mean you can make up what went and goes on elsewhere! - Try again

Here is the testimony of Catherine Anthony of the DOE during the trial for the funding, that we won, about the side issue of incompetence and $10 million the district spent, not to GIVE SERVICES, but to END SERVICES to students in yeshivas, that were mistakenly initiated in the years before 2012. Here is the chart:
ReplyDeletehttps://arthur2240.ipage.com/documents/State%20Docs.pdf
Here is the testimony:Q Okay. And then the fourth column, what is the heading for the fourth column? A “Enrollment Status of Student Post-Settlement.” Q And it appears that for all of the items listed here, the designation is “Disenrolled.” A Correct. Q What -- what -- when you created this document, what did that term, disenrolled, mean? A It means part of the settlement agreement listed that the student would be disenrolled from the district. Q Okay. So they would no longer be a registered public school student in the District of Lakewood. A I am assuming, yes. MR. INZELBUCH: I’m sorry. “I’m assuming, yes?” THE WITNESS: Uh huh. MR. INZELBUCH: Is that what you said. THE WITNESS: Uh huh. BY MR. STARK: Q So then the fifth column over there, what is the heading for the fifth column? A “Number of Years Covered by Settlement Agreement.” Q Okay. And so I see a number of different -- in addition to different numbers, I see a number of different terms in there. So if we look at the first number -- excuse me -- the first row in that column, it’s a number three. What does that three represent? A Three school years. Q Okay. So is that the term of the settlement agreement that you reviewed? A Yes.
…
MR. INZELBUCH: Your Honor, as an Officer of the Court and as this Court knows, ESY doesn’t go – so we can sit here and we can make it very clear – ESY never goes to August 31st. Number two, as an Officer of the Court, we could say whatever we want, but I’m going to say what I want. THE COURT: Mr. Inzelbuch, you’re not going to say whatever you want. MR. INZELBUCH: Well, I’m going to say it, so you can hold me out of order. THE COURT: You are out of order. MR. INZELBUCH: This chart -- this chart is not correct. THE COURT: You’re -- MR. INZELBUCH: This chart has changes. THE COURT: Then -- then Mr. Lang will be able to question. MR. INZELBUCH: Mr. Lang is not able to do anything of the sort. THE COURT: Mr. Lang represents the petitioners. MR. INZELBUCH: That has nothing to do with this chart. THE COURT: You do not, Mr. Inzelbuch. MR. INZELBUCH: I’m just letting you know, and I’ll say it for the record -- THE COURT: I don’t want to have to hold you in contempt. MR. INZELBUCH: I understand. You can hold me what you want. This chart -- Mr. Lang has nothing to do with Mr. Lang’s doing cross. THE COURT: Mr. Lang can make -- do whatever questioning he wants. So the witness can continue.
…
A. We reviewed the information that was in the settlement agreement, the tuition, and any related services that might have been listed with -- in the agreement. Q Okay. And so the last -- the last item I wanted you to ask -- I wanted to ask you is to turn to the second page of the document, Bates labeled DOE-1953. There is a number at the bottom of the – the bottom right of the chart, 10,176,771 dollars. What does that number represent? A It represents the sum of all of these rows added together. Q Okay. And so when you say “all of the rows,” that’s all of the rows in column six? A Correct. Q Okay. MR. STARK: Your Honor, I’d like to move this exhibit into evidence. THE COURT: Well it’s subject to cross examination first. MR. STARK: Of course.BY MR. STARK: Q Does this -- and so it’s your testimony that this chart is an accurate representation of the work that you conducted? A Yes. Q Okay. Thank you. MR. STARK: Your Honor, I have no more questions. THE COURT: Mr. Lang, do you have any cross? MR. LANG: Your Honor, I have no questions, but just out of deference to Mr. Inzelbuch, I just will ask that question that he asked. CROSS EXAMINATION BY MR. LANG: Q I believe the question was, what is ESY? How long does it go to? Does it go to August 31st? A I can’t answer that
I had no interest in arguing with the evidence the state presented. All throughout the trial, the state argued this figure or that figure might not be right, did you consider building a bridge over Route 9, fortunately Mr. Figure testified that it would take a lot of bridges, and they admitted nothing, not even the numbers on their website. The state's strategy, like when I started in the district, blaming the problems on courtesy bussing, is to distract away from the real issue. Still is. Unfortunately the BOE got suckered by the dirty tricks of the state during the trial and afterwards. I hope they realize they were duped.
ReplyDeleteIt is not about the BOE in court.
DeleteThe state suckered Lakewood for two decades. The Bacon decision Lakewood lost in 2003 made an issue of courtesy bussing.
My first year in the district I realized we were losing tens of millions of fair state funding because we (the district) allowed the state change the argument to courtesy bussing, which might have been less than two million then, and maybe four million in 2014. B"H courtesy bussing has not come up for a while.
The town as a whole is total hefkier with no leadership. There is no person with whom the buck stops. Why do you think people cannot do great public works in Lakewood, build roads, do what is done in any great city like NYC or Houston?
Every corporation, government, and association, has to have somewhere the buck stops, someone who you can go to for the support of a vision that is way out of the league of the unimaginative. AL
Rav Pupko zt"l was an ish emes. He didn't stand for shtick or shtick machers. Yehi zichro baruch!

ReplyDeleteThe governor of NY is taking up the Lost Cause argument, a cause that will never be lost as long as the US remains a republic. Power has been shifting back to the states. The Court has slowly been chipping away federal power since its height under FDR.
ReplyDeletehttps://www.youtube.com/watch?v=8AYQ4TaPrYo
BTW FDR secretly blocked Robert Moses from building the Brooklyn-Battery bridge by way of the Navy undersecretary because of the Brooklyn Naval Yards. This is different. It is a true encroachment on states' rights.
I don't think they are referring to Rita's. There are other frum establishments such as jus by juli and Joseph amd David. Maybe they didn't do enough research before opening. The location is t the greatest either
ReplyDeleteThe NY governor is going to beat Trump up and the Roberts Court will help. The power of the federal government keeps getting weaker under Roberts with Republican blessing.
ReplyDeleteIn June 2024, the Supreme Court overturned the Chevron doctrine in the case Loper Bright Enterprises v. Raimondo. The Chevron decision, which was overturned, gave the executive, by way of federal agencies, deference in interpreting the law shifting the burden of proof in favor of the government. So now that Chevron was overturned, no president can any longer find some act of Congress and the Court gives his administration deference. The standard used to be ultra vires, meaning that the power is clearly beyond what Congress created, like when the Court held that EPA can make CO2. a pollutant under Environmental Protect Act. That for sure will be overturned. This a great time to be an America. Exciting. The country is not in danger, So much action and this time, it will be played out in the Courts, not Gettysberg.
There is nothing in the Constitution that gives the president power over the states without an act of Congress. And since the court overturned Chevron, I don’t see how Trump will win against Hochul. And the chutzpah"“CONGESTION PRICING IS DEAD. Manhattan, and all of New York, is SAVED,” he texted. “LONG LIVE THE KING!” and saying to the Maine governor that "I am federal law."
He might get away with the Maine thing through the Department of Education, but the USDOE is now weaker, thanks to him. Hopefully he will dismantle it. Trump was for Chevron being overturned.
This is how the Democrats will make their come back. The biggest federal power grab after interstate commerce and the spending power, was substantive due process, and that looks like it will come to an end with Dobbs.
And here is my predication, the son the baseball player who got hurt and left the minors, Andrew Cuomo, will be the next mayor. Maybe he will be the Johnny Rebel to protect the raaaaaghts of his state. Exciting time.
Trumps envoy, Witkoff, was also on Face the Nation. Excellent segment. He said the deal with Russia is business. Of course. What did you expect out of the president. American business are going to get their hands on Russia. Putin has laid his tentacles in this country, so good riddance. That together with getting mineral rights in Ukraine could be a big boon to America. Still, I am apprehensive with anything to do with Russia. And Ukraine still did not say they will give up. The Russians are going to want bribes from US businesses working there and the US government can go after the businesses that bribe foreign governments under the Federal Corrupt Practices Act. So these companies are going to have to kowtow both the US government and Russia. They still will make a ton of money.
