How can you petition the ICC against draft dodger arrests by Israeli military? Putting aside mesira and putting aside that Israel does not recognize its jurisdiction, the ICC has a very limited jurisdiction. It prosecutes individuals, not countries for international crimes. They do not claim they have the ability to prosecute internal affairs. More importantly, if you go to the ICC for judgement and they rule that it is correct to draft Lomdey Torah that means you accepted your legal obligation to do so. The ICC is not going to prosecute a case when the plaintiffs are not committed to accepting their ruling.
ReplyDeleteThat is incorrect. The ICC is little more than a busybody organization. As such they do not require the plaintiffs to accept their ruling. They only accept cases from (1)sovereign countries (2)the UN security council or (3) if their prosecutors decide to intervene. Once (3)happens, the person who went to them trying to convince them to do so is not under any obligation to accept it's ruling. You are correct that the ICC about mesira and that the ICC prosecutes individuals. Not countries. And only for international crimes.
