Poskim and gedolim issue letter of compliance for Lakewood  bais din stating from today onward the bais din of the “Bais Havaad of Lakewood” is not presumed to be a legitimate bais din - un-til they comply with the abovementioned demand without delays or pretexts and in a manner that we find satisfactory.
Full text of letter:

Psak Halacha from Leading Gedolim and Poskim Regarding the Status of the “Bais Havaad of Lakewood”

"It has been some time since leading Rabbanim and Roshei Bais Din asked a panel of mem-
bers of the “Bais Havaad of Lakewood” to consent to a hearing before an agreed- upon
third-party Bais Din to present any and all investigations, processes, evidence and find-
ings upon which they based their ruling which permitted (or misled others to permit) a
kohen to marry a giyores. To date, the requested hearing has not taken place.
We therefore state our opinion, that since the members of the abovementioned panel con-
tinue to serve as dayanim at the “Bais Havaad of Lakewood”, from today onward the bais
din of the “Bais Havaad of Lakewood” is not presumed to be a legitimate bais din - un-
til they comply with the abovementioned demand without delays or pretexts and in a
manner that we find satisfactory.
Therefore, henceforth: a) one is not obligated to respond to any summons (hazmana)
issued by the “Bais Havaad of Lakewood” and b) any document or certificate attesting
to a maaseh bais din that may have been performed by, or have had the involvement of
any of the abovementioned dayanim (including permission to marry based on gittin that
they administer henceforth) is not presumed to be a valid maaseh bais din. (See Chazon Ish CM Likutim 2:1-2.)
To this we affix our signatures, with much pain,

Rabbi Shloime Miller Rosh Kollel & Av Bais Din of Toronto; Rosh Bais Din of Bais Horaah of Lakewood
Rabbi Elya Ber Wachtfogel, Rosh Yeshiva of South Fallsburg
Rabbi Avrohom Bromberg, Rosh Yeshiva Shaar HaTalmud
Rabbi Sariel Rosenberg, Av Bais Din of Bnei Brak (founded by Rav Nissim Karelitz)
Rabbi Nochum Eisenstein, Rav of Maalot Dafna Yerushalayim
Rabbi Asher Hachuel, Sephardic Bet Din of America
Rabbi Shraga Feivel Zimmerman, Av Bais Din of London
Rabbi Yitzchok Stein, Av Bais Din Faltichan Brooklyn

    1. A year ago, R' sholom kamenetsky's bais havaad issued a crazy psak, for the past year they've been asked by all the rabbonim to explain themselves, and they stonewalled. Finally all the rabbonim had enough. A bais din that hides and won't take responsibility for what they pasken, is not a bais din, and their hazamos may be fully ignored.

  4. Someone please explain. A Psak regarding a Lakewood Bais Din, without even one signature from a Lakewood RY/Posek/Dayan ????

    1. Looks like politics at its best. A Din Torah that one of the parties lost and was willing to bashmutz a respected Mosad in our community. You are right, not one Lakewood Rov Dayan or Rosh Kollel signed on it because this is politics at its best. If we learned anything from Korach, we should all stay far away from all this. I belieive this Kol Korei should be ignored.

    2. Correct. And I'm aware of at least a few of the signatories which are related to the subject party and are therefore passul to give any psak on this matter.

    3. A few months ago At least three dayanim who were part of the Bais Havaad bais din for many years resigned and broke away from the bais Havaad.
They left because they saw the corruption and didn't want to be part of it.
This is real! Not motivated by any Negios aka politics

    5. No this is not from a losing party. The family in question wishes it would be over, however the gedolim brosham rav wachtfogel insist on continuing as they see this as something that they cannot let someone get away with such a hirus hadas.

    7. So signing a tzetl shows that they are against the BHV. And not signing the tzetl shows that they are against the BHV.
      Awesome logic!

  11. Each name on letter very respected in their own right. Big names. As for the Lakewood names. Rav Miller and Rav Bromberg are about as Lakewood as you get. Rav Miller signature speaks for the entire bais horaah. Besides most Lakewood Rabbonim are involved with one bais din or another, and can't sign because of conflict of interests.

PSA WARNING - NY/NJ E-ZPass account customers whose E-ZPass Tags are not properly mounted and not positioned for accurate readings while traveling Port Authority crossings, will be charged a Mid-Tier rate for their tolls. The Mid-Tier rate is higher to cover the incremental cost to process the toll transaction (license plate picture and account verification), however, the Mid-Tier rate is lower than the full toll rate with Tolls by Mail.
Saving your license plate number to your account will not help you now need a tag!

Extra 2.66-4.66 if an ezpass tag is not read (but saved to the account)!

(I believe there was also a 3rd Rosh Yeshiva, Rav Chaim Kahan, who was niftar young.) Rav Kagan was born the same year the Chofetz Chaim was niftar so his parents gave him the name Yisroel Meir. They are not related, even though they are also Kohanim.
Rav Yaakov Kamenetzky is the grandson of Rav Kagan, as well as the son of Rav Shalom Kamenetzky Shlita (Rav Shalom's Rebbetzin is Rav Kagan's daughter).

  20. 1. The Beis Havaad were not the ones who issued the heter. Nobody can show me anything from them that is matir this story. They did the research, on which the Rabbonim based their heter.

    2. The Beis Havaad have repeatedly shown a willingness to explain their research to anybody who really wishes to know the answer. But not to those who have already publicized their opinions against the Beis Havaad. For obvious reasons. Yet they are still attacked for 'not showing their reasoning.' One of those who signed against them was invited on the day he signed to come and see their reasoning, yet signed a letter that they are not showing anything.

    3. The people behind this maaracha know all of the above, yet are pretending it didn't happen. Why? Why are people messing with your heads?

    4. The people running this maaracha have had much practice in running maarachos. Most failed, but they are learning from their mistakes. They are pretending to piously demand halachic transparency, yet think they have hidden the pashkevilln they wrote, the blogposts they uploaded, and the claims they have made.

    5. The end purpose here is to undermine the power of Beis Din. The Beis Havaad has settled countless disputes, in which both sides are satisfied. They have responsibly dealt with numerous Gittin, and with ease and smoothness that prevents the agunos issues that crop up on so many occasions. Losing sides of Dinei Torah are satisfied that their side was heard. Closing down the Beis Havaad, and especially Reb YY Semiatycki, means the entire town loses out. This is why no locals signed on to this maaracha, and this is why it will ultimately fail.

    6. The question remains, during the WZO tumult, this wasn't a problem. Why not? What suddenly happened? The answer is clear. When the tumult makers have other occupations, this is a non-issue. Beware of people with too much extra time on their hands.

Cool heads will prevail when the tumult simmers down and people realize there's politics at play here, at best, and chashuvims stance manipulated to malign a bais din that operates with the utmost Torah integrity. Cool heads will prevail as emes always emerges to the forefront, sheker has no legs. If it's a matter of time, then time it will be. 2. Cool heads will prevail that you cannot be matir a cohen and a giores to marry. If you do, you need to transparently explain your psak to the greatest poskim.

This is so similar to the bitul kidushin fiasco of a decade ago. Stonewalling, doubling down about a secret psak which matired an eishes ish without a get. Only when the outcry and pressure became so hot, did cooler heads prevail and some of the matirim went to a beis din of Rav Dovid Feinstein - which they chose - who confirmed that the original kiddushin was not botel.

Some of the same people - who secretly gave the heter back then - are involved in this bittul kehuna.

We look forward to this being resolved al pi halacha, very soon. For now, the great rabbonim have spoken.
