Bagatz Ruling: Halt Funding to Yeshivos as Exemption from IDF Draft not Legal

 From Jpost- The High Court of Justice on Thursday night issued a blockbuster decision ending a significant portion of state funding to charedi yeshivot beginning on April 1.

The decision's immediate financial implications were not immediately clear, but the ruling indicated that the blanket exemption for charedi yeshiva students is no longer legal.

 

The decision could potentially destabilize Netanyahu's government if its two haredi parties, United Torah Judaism and Shas, decide to exit the government.

The original law that granted the haredi exemption was ruled unconstitutional already in 2017, but did not officially expire until the end of June last year. Prior to its expiration, the government passed a decision to give itself until the end of March 2024 to formulate a new law. State funding for yeshiva is contingent on the number of students with legal exemptions, and with March ending and no new law in sight, the court ruled that there was no longer a legal basis for the funding to continue.

However, the ruling applies only to those who reached military age after the law expired in June 2023, or those whose military deferral ended after the law expired. Yeshivot will continue to receive funding for students who do not fall into these categories. In addition, yeshivot require a minimum number of legally exempt students to receive funding, and if the ruling pushes certain yeshivot under that number, those yeshivot can continue receiving support for their legally exempt students until the end of the yeshiva school year on August 9.

The decision went further Attorney-General Gali Baharav-Miara's position, which was that the yeshivot should be granted a short period after April 1 to adjust to the new reality.

At press time, the court did not issue a ruling on a second set of appeals that demanded that the state begin to actively enlist yeshiva students.

Technically the decision was an interim order, such that the court also ordered a hearing before an expanded panel of nine justices to be scheduled sometime in May to resolve a variety of issues raised by its decision, and which could lead to the decision being final.

- Giyus Update: a last-minute U-turn, the government requests a half-day extension until 2pm tomorrow to the High Court’s deadline for filing a response to petitions demanding that the state immediately start conscripting ultra-Orthodox yeshiva students. The Attorney General’s Office had filed a draft response asserting that the state would be obliged to begin conscription for such men on April 1 after a government resolution postponing drafting procedures expired but sent out the deadline extension request shortly afterward.

- Giyus Bnei Hayeshivos: The Attorney General recommends to Bagatz that beginning April 1, all Bnei yeshiva will lose the exmption status from the army and technically will be obligated to be conscripted and drafted to the IDF. With regard to funding to yeshivos the recommendation is it should not cut it off immediately but enough to have a transition period. Frum journalists blasted the charedi MK"s for failing to deal with this issue and not making it a priority during this government.

- Rav Moshe Hillel Hirsch said the yeshivos in EY should continue the zman until 7 Nissan to start bein hazmanim, and there should be no organized trips during the off weeks. If the matzav changes the yeshivos may end earlier at the usual time Rosh chodesh Nissan.

Moetzes Gedolei HaTorah Releases Kol Korei Before Taanis Esther 5784

It is a time of suffering for the Jewish people, may we be saved from it – and we can only rely on our Father in heaven. With this knowledge, we approach Hashem to pray for our lives: “For our lives we beg; for our nation we implore.”

The situation of our brethren around the world concerns us. Hatred of Jews and Judaism increases, may Heaven help us, especially in Eretz Yisroel – now plunged into war. In addition, the lives of the hostages are hanging by a thread, may Hashem have mercy upon them and redeem them from captivity.

The uniqueness of Taanis Esther as a day of prayer is well-known, as the Kav HaYashar writes, “Through prayer on this day, [we] awaken much Heavenly mercy.” This is a time that teaches us that those who trust in Hashem will suffer no shame or embarrassment.

Therefore, we ask our brethren to designate a specific time on Taanis Esther to listen to words of hisorerus – let us seek to improve ourselves – and to recite chapters of Tehillim (including chapter 22), and to pray for our brothers who are in pain and in captivity, and for the redemption of Moshiach’s arrival – for which we long every day.

Eligibility For the NJ Student Support Act

 The New Jersey student support act  that was introduced in Trenton establishes program in the dept of treasury to provide tax credits to taxpayers contributing to organizations which awards  scholarship to certain non public  school  students. according to Teach NJ they hope to have a vote in June 

How will eligibility be determined? how will it work?  based on the initial bill submitted there will be student support organization that will receive contributions and administer the scholarship to eligible students that are in non public schools who are part of the national school lunch program, The student support organization can only spend 5% on administrative costs and is in charge of reviewing applications for schools by eligible families the max of contributions allowed per year is $250 million. Any student from any school or region in NJ can apply and scholarships amount must be equal to all, if there's too many students a lottery system will take place for the new applicants,  

Eligibility: A student is required to have a household income that does not exceed the federal income guidelines for reduced price lunch under the national school lunch program multiplied by 4.32. 

So a family of 4 who can make up to $55.500  for reduced school lunch can multiply that by 4.32  can make up to $239,760 and be eligible for tuition scholarship family of 8 can make up to $404k  (the income levels go up slightly every year)

Tuition Relief Bill Introduced Today in Trenton

 What everyone has been waiting for

Thr New Jersey Student Support Act" was introduced today in the NJ legislature. This project started with the Modern Orthodox school of New Jersey teach NJ with the Lakewood kehila joining in under the UENJ. The bill will give tax credits for companies who award scholarships for private schools.

Establishes program in Department of Treasury to provide tax credits to taxpayers contributing to organization which awards scholarships to certain nonpublic school students.

Identical Bill Number: S3035. The bill sponsors are all democrats. They will need republican support for it to pass.
