Summer Bein Hazmanim Begins in Lakewood

For the kolell youngeleit of Lakewood, and Bochurim of BMG summer 2020 vacation begins now as they rest up before resuming to the shtender for upcoming Elul Zman. This past zman was challenging because of the Coronavirus but it did not stop the kol Torah as learning continued in its intensity until Tisha B'av. The learning of course continues in local Botei medrashim some with special bein hazmanim programs. During these weeks one experiences a feeling of relaxation and serenity in Lakewood. This year with covid19 options for going away on vacation are limited and many famillies will staycation instead.

Halachos of Motzaei Tisha B'Av that falls on Thursday night

- Generally, every year, on the 10th of Av, the restrictions apply until Chatzos (i.e. showering, hair-cutting, washing clothes, music, and wearing fresh clothes). However, this year, since the 10th is Erev Shabbos, l'kovod)Shabbos, these restrictions are relaxed.  Bathing and hair-cutting are allowed, preferably friday morning but, if need be, Thursday evening.  If it is not for kovod Shabbos, the restrictions still apply.  A shower that not for kovod Shabbos is only mutar with lukewarm water.
Regarding doing laundry, even though there are those that are machmir until Friday, there is a strong heter to do laundry Thursday night. Laundry on Friday is permitted without limitation
Listening to music is not permitted until chatzos.

1. After Chatzos (1:03 pm) on Erev Tisha B'av some poskim hold the minhag is not to learn anything which is Assur on Tisha Bav itself. Only that which is Muttar to learn on the 9th of Av. (see below for permissible learning)
2. We do not say tachnun after Mincha on erev Tisha Beav. One may not take a leasurly stroll unless he does it commonly for health reasons.
3. It is prohibited to fast on Erev Tisha bav. We eat a  final meal before the fast, it is called the Seudas hamafsekes סעודת המפסקת the seudah which separates from eating to beginning the fast of Tisha b'av
4. It must be eaten after noon and before shkiah/sunset (at 8:13 pm) and no other meal may be eaten thereafter. One may drink water or eat if he did not assume the fast after the seudas hamafsekes.
5. The Seudas Hamefsekes may be preceded by a regular meal the minhag is to daven mincha in between the 2 meals.
6. The minhag  for the seudas hamafsekes is to eat only bread and water, and a boiled egg dipped in ash some dip the bread in Ash.
7. The seudah is eaten seated on the ground or on a stool within 3 tefachim, we do not socialize, we it alone and avoid eating three people together to not have  a chiyuv of zimun
8. If  One wants to drink water or eat after the seudas hamafsekes untill shkiah it is better if he stipulates his intent verbally to do so before bentching.
9. We may not sit on a chair after sunset. Shoes are to be removed before shkiah.
10. Individuals who will not be fasting should eat a Seudas Hamafsekes.

JHS: Great American Jewish Cities - Cleveland Part 1&2

This great city of the Midwest hosted some impressive events, institutions and personalities throughout its Jewish community's long history. Once a center of Reform Judaism with Abba Hillel Silver, it was also home to one of the earliest short lived Yeshivas in the United States when Rav Yehuda Levenberg moved his New Haven Yeshiva to Cleveland.
Rabbi Israel Porath was the long time Rabbinic leader, but it was Telz Yeshiva and its great leadership that really transformed the town. Rav Elya Meir Bloch, Rav Mottel Katz, Rav Mordechai Gifter, Rav Baruch Sorotzkin and many more transformed Cleveland and the Yeshiva world at large with the aristocracy of Telz. The Telz impact was felt with the founding of the Hebrew Academy by the Dessler Family and the Yavneh Girls school. The great philanthropists of Cleveland included Irving Stone, the Spero brothers and Mendy Klein.
Chassidus struck roots in Cleveland with the Cleveland dynasty, Chabad and even Kaliv.

As a result, the CDC is discouraging people from getting tested a second time after they recover.

-DR Zelenko update: Update: According to reports, the surgeon was very happy with the results, it went extremely well. BH. Zev is in recovery and even though heavily sedated and with a breathing tube, he responded to his wife's presence with his eyes. The specimen is being sent to a special lab in California so the pathology report may take time. Meanwhile Zev is in ICU for 24 to 48 hours, and begins the long road to full recovery BH  please continue to pray for Zev Ben Leah (Donate HERE)

-Second round stimulus check: Pending a final agreement which did not take place. Treasury Secretary Steven Mnuchin said that, “Our proposal is the exact same provision as last time.”  the current plan would result in all families and singles receiving the same stimulus payment that they received in the last round of funding. $1,200 for singles and $2,400 for couple plus $500 for each child. The payments would be full until an individual reaches $99,000 in income or $198,000 for a couple.

Halachos for Erev shabbos in the 9 days (Based partially on Rabbi Felder Sefer)

Erev Shabbos in the nine days (or Chazon)
-One may cut their Nails for Shabbos since it is not shavua shechal bo.
-One may polish their shoes only with liquid polish according to most poskim.
 -One may brush a hat on erev shabbos since it is not considered washing clothes.
 -Showering is a machlokes if you are allowed kol gufo, the minhag is to be meikel but to use warm water.

KAJ discontinues Hashgach on Empire poultry. Currently Empire is under the kosher supervision of the OU and Tartikov Hashgocho under Rabbi Yechiel Babad.

KAJ Statement:
 After many years of giving the highest levels of kashrus supervision at Empire kosher Poultry we will be removing our Hashgocho effective  July 20, 2020. This decision was made after much discussion and  deliberation both with Empire and internally. Unfortunately, circumstances have developed that prevent us from being able to guarantee that our standards of  kashrus will continue to be met. Today is the Yartzeit of Harav Elyashiv Zatzal
Rav Shlomo Elyashiv was one of the greatest Kabbalists in recent Jewish history. Settling in the town of Shavl, he proceeded to author his magnum opus the Leshem Shevo Veachlama, and influencing young Rabbis like Rav Kook in kabbalistic teachings.
In 1924, he moved to Eretz Yisroel together with his daughter and son in law Rav Avraham Levinson who changed his name to Elyashiv at this time. They were accompanied by their Bar Mitzvah age son, the future Rav Yosef Shalom Elyashiv.

Judge Dismisses Lakewood BOE Lawsuit for Not Providing $30 million in State Aid

A Judge has Dismissed  lawsuit brought by the Lakewood BOE against the dept of education. The state last year initially was to give Lakewood $30 million in funds but than it was  stripped out of the budget. The BOE passed the budget assuming it was getting the funding.
The Lakewood Shopper reports that the judge ruled Lakewood BOE does not have standing to assert the various claims in the complaint.

R' Aaron Lang  a lakewood lawyer and teacher  who initialy sued the state to change  the funding formula for Lakewood ads:

The district’s case in federal court was dismissed for the essentially the same reasons its case was dismissed last July in NJ administrative Court. Besides for being moot due to the loan,
the court reasoned that it would have had to interject into the political process and the sovereignty of the legislature. See EDU 08386-2019.
As for standing issue in the federal filing, the state tried to dismiss Alcantara in 2015 saying that district has standing, not my students. This was convenient for the state to argue since the BOE did not want to join me. NJ law has been clear since the 1980s that students have standing, not a BOE.
What perplexes me is the federal filing. San Antonio v Rodriguez 411 US 1 (1973) says that education is not a fundamental right. The Supreme Court also said that disparities in funding based on wealth and geography do not violate equal protection. The NJ funding law does not discriminate against a protected class (San Antonio ISP's students also were mostly members of a protected class) So the discrimination argument does not seem to have merit. The SFRA is rational under the federal constitution because its disparately affects everyone in Lakewood, not just those of a protected class. (Many people would like to see San Antonio reversed, but Lakewood will not be the test case).

The only cause of action is under the T & E clause of the NJ constitution, not federal.

The Amazon scam is not new, but it looks like it may be making its rounds again to Lakewood residents. People have received a phone call from a person claiming they were from Amazon and that they owed money on their account. Just a reminder; Amazon will NOT contact you for money. They are trying to get access to personal financial information. In some cases threatening that you will be forced to pay for a package that will be delivered.

Rav Yoel Teitelbaum, the pervious Satmar Rebbe, would encourage his chassidim to pray at the tzion of the Rav Yaakov Yosef. It is reported that many people have found a yeshuah after visiting the tzion.

LAKEWOOD, New Jersey (Kyodo) -- A photocopy of a transit visa issued by the then Japanese envoy to the Soviet Union to help a Jewish refugee flee from Nazi Germany during World War II has been preserved in the hands of her relatives, the family said. While it is already known that Ambassador Yoshitsugu Tatekawa issued travel documents for Jewish refugees, it is very rare to confirm that he also issued visas for them.
The visa was issued for 17-year-old Rischel Kotler on March 8, 1941 at the Japanese Embassy in Moscow.

Perhaps no other city in the United States can boast of such a long, rich and consistent Jewish history narrative as the City of Brotherly Love. Historic synagogues like Mikveh Israel - which at one point received funding from Benjamin Franklin, and Rodeph Shalom which was the first Ashkenazi shul in the Western Hemisphere are symbols of the colonial era Jewish community.
The 19th century saw Isaac Leeser, Sabato Morias, Marcus Jastrow and others make their mark on the development of Philadelphia Jewish life and their influence on the wider American Jewish community. The interwar period brought Chassidic Rebbes, great philanthropists and even the Lubavitcher Rebbe - who visited the Liberty Bell - to Philadelphia.
Led by a succession of great rabbinical leaders like Rabbis Bernard Levinthal, Ephraim Eliezer Yolles, Baruch Leizerowski, Sholom Shneiderman, Moshe Lifshitz and many others including the contemporary Rabbi Avraham Shemtov. The Philadelphia Yeshiva was founded by Rav Shmuel Kamenetsky and together with Rav Elya Svei, Rav Mendel Kaplan and other greats have made it one of the premier Torah institutions in the United States.

 Petirah of Harav Avraham Mordechai Hakohein Isbee, zt”l, who served as the Rosh Yeshiva of the Gerrer Yeshiva Beis Yisrael in Ashdod. He was 79 years old.
Rav Avraham Mordechai’s family hailed from Detroit, Michigan, where his paternal grandfather, Reb Nechemia Isbee, settled a century ago. Reb Nechemia imbued his family with his great mesiras nefesh for Yiddishkeit as he raised an illustrious family of bnei Torah in the wilderness of America. His son, Rav Leible, went to learn in the great yeshivos of Europe, and his daughter, Rebbitzen Shifra, married Harav Gedalia Schorr, zt”l. Reb Yaakov Isbee raised his family in the same manner, sending his son Avraham Mordechai to learn in Telshe Yeshiva in Cleveland.His levayah was held Monday morning in Yerushalayim, and kevurah was on Har Hamenuchos. -The New York State Department of Health released a foreboding letter of guidance concerning sleepaway camps in which they reiterated the restrictions on sleepaway camps in New York State, and reminded the camp operators who have received temporary residence permits of the need to follow rules put in place during the pandemic. The guidance included a reminder of potential large fines for each -violation. -Some coronavirus patients on respirators passed away not because of their illness but rather due to grave negligence and significant failures made by an unskilled nursing staff, reported Yisrael Hayom. The deaths took place in a special corona ward at the Wolfson Medical Center in Cholon where the patients in critical condition were being treated.  one incident where a coronavirus patient was recovering from the respirator and a nurse fed him incorrectly. The patient then choked to death when the food got stuck in his esophagus. Oddly, that patient’s cause of death was listed as coronavirus. Hamodia

- A report released Wednesday by the Monmouth County Prosecutor’s Office found the officers who arrested  APP Lakewood reporter  “had no knowledge they were apprehending a reporter,” clearing them of wrongdoing.

- A Judge in NYC grants Ezras Nashim the all female orthodox volunteer ambulance company , a license to operate their ambulance service. The Ruling reversed a decision by the Regional EMS Council of NYC. Hatzoloh will appeal with a  hearing set this afternoon.

PUBLIC HEARING

Today In Person Primary Elections In Lakewood

New Jersey is holding primary elections today with multiple congressional primaries across New Jersey.  There will be 9 polling stations open for in person voting in Lakewood  the 43 districts will be combined at these locations see list  below. Voting will be by paper ballot no machines
The vote  was  largely by mail in Ballot. If you did not vote by mail you can still submit your ballot if it is post marked by 8:00 pm today.  Lakewood residents can also drop their ballot at the secure ballot collection box outside the Northern Ocean County Resource Center at 225 4th Street in Lakewood.
 In Lakewood, on the Republican side, Harold Hershowitz is challenging Committeeman Mike D'Elia . On the Democratic side, Mayor Ray Coles is running unopposed for a 7th term.

As of Monday, election officials had received just under one million ballots, according to the secretary of state in NJ.
It is unlikely that official results in New Jersey will be known for at least a week.

For those in Lakewood voting in person, the 43 districts will be split among 9 locations:

-Selective enforcement against the frum community in Eretz Yisrael by the Israeli police for non compliance in wearing a mask even if its not on correctly, while in Tel Aviv they are handing out masks to those not wearing one. A video shows a 13-year-old Charedi girl walking a baby stroller being detained by police for not wearing a face mask.
