All 4 counts against the foundation were declared not-guilty.
On counts 1,2, and 4, against R’ Eisemann, the jury said not guilty. Those were the ‘serious allegations’.
On Count 3 and 5, the jury said guilty.
Count 3 was ‘money laundering’, which the defense lawyers argue is not possible to violate unless you’re convicted of count 1,2, or 4. Reason: According to the text definition f the law, ‘money laundering’ is the concealment of the origins of illegally obtained money. But once the jury declared that the money was obtained legally, by virtue of issuing non-guilty verdicts on counts 1,2, and 4, it’s then impossible to have a money laundering charge, which by definition refers to money obtained illegally.

Group to Develop 65 acres of Cedarbridge, Stores and Office Complex

 A New York City real estate firm will purchase about 65 acres at the township's Cedarbridge campus  located near Pine Street and Cedar Bridge Avenue, APP reports . Somerset development was tapped by the real estate group to develop the property according to the report. Plans for a complex of office buildings and retail space.  Pinnacle Group said Zucker will be joined by Meridian Capital Group, a commercial real estate finance and advisory firm, and architect Ian Bader, a partner in Pei Cobb Freed, an international architecture firm, in developing plans for the property. The goal is to create a "better environment than just a building and a parking lot," he added.

Cedarbridge has been designated an Opportunity Zone. Opportunity Zones were created as part of the 2017 federal Tax Cuts and Jobs Act. Investments in new businesses and developments in the zones, which are located in distressed areas around New Jersey, may be eligible for new tax benefits.

 “The most important thing is that it’s a tremendous victory for R’ Eisemann & the entire defense team. What this case was about according to the state, was about the theft of public money that’s what the Attorney General said in his press release. That is what they opened on and closed on. What the jury said loud & clear – there was no theft of public money, no Public money was taken, private money was used and Private money is without restriction, not regulated by the dept of education. So at the end of the day first & foremost this is a big win for Justice & the truth The first day we met he said ‘i never took a dollar from the school, I would never take a dollar from the school,’ and the jury agreed. What they convicted on was first of all legally indefensible and we’ll show that to the judge and if not to this judge, to the appellate division. And once count 3 falls away, count 5 can’t stand either. So at the end of all of this, all the counts will be gone it will all end up in full vindication of R’ Eisemann but the most important part of today – the jury agreed that he never stole public money & the state’s theory was flawed”

Summary:

There were 5 counts against R Eisemann and 4 against the foundation.
All 4 against the foundation were dismissed.
Counts 1,2, and 4 against R’ Eisemann, the jury found not guilty. Those were the ‘serious crimes’. Count 3, which the jury said guilty to, was money laundering which the defense says is only possible if one count either 1,2 or 4 is guilty. But since they were not, they are hoping count 3 will be dismissed.
Count 5 is ‘misconduct by a corporate official” – this is only applicable if one other crime was guilty. In addition to a crime – there is mistrust but without a crime, no mistrust took place!
The defense will now file a motion – based on this – to dismiss the case.
As is, this ruling is better than the plea deal that was offered.
There is a possibility the result would only be a monetary compensation…

Toms River council adopt Resolution against Hate, Bigotry and Prejudice.

TR council members unanimously passed the resolution against hate, bigotry and prejudice but did not  single out any hate group. Prior to the council meeting the Simon Wiesenthal Center will held a press conference to condemn the anti semitic group ‘rise up’. They asked the  Toms River Township to pass a resolution against hate & against this group. see earlier article from Hamodia newspaper (see photos video at LNN)

Ocean Freeholders Label Facebook Group As Anti-Semitic

 Patch.com - TOMS RIVER, NJ — An Ocean County group with a growing Facebook page has been denounced by the Ocean County Board of Freeholders, who adopted a resolution on Wednesday calling the site anti-Semitic and urging its administrators to reveal their identities.

"the administrator, who spoke on condition of anonymity, said the group's administrators — there are nine, including two who are Orthodox Jews — spend a great deal of time policing the page for comments that are anti-Semitic and removing them

"While the Board of Chosen Freeholders recognize the right of free speech to all Americans, the conduct of the creators and administrators of 'Rise Up Ocean County' is contrary to the goals of American free society and liberty," the resolution reads in part, and goes on to condemn "such hate speech." Administrators of the Rise Up Ocean County Facebook page, which has more than 7,000 members, say their concerns are not about religion, but about the effects of overdevelopment on Ocean County and of fair application of laws.

When there are 2 months of Adar the Halacha is that a bar Mitzva boy who was born in adar of a regular year celebrates it on Adar Sheini. This year 5779 is a leap year, however 13 years ago in 5766 was not a leap year therefore any child born between the first and 29th of Adar 5766 will become Bar Mitzva on the corresponding day of Adar Sheini. Therefore no one can become bar mitzvah between the 1st and 29th of Adar Rishon because 13 years ago there was no Adar rishon

Yesterday, a judge declined to dismiss most counts against the Westlake Golf & Country Club in Jackson in a lawsuit brought by Rabbi Philip Lefkowitz. In Boro Park too, Pediatricians Shift Away From United Healthcare Medicaid Plan

While no official reason was given for UHC’s sudden rate cuts, theories abound, especially as the same phenomenon has occurred over the past year in Lakewood and Williamsburg.

“They’re targeting frum neighborhoods because large families are costing them too much money. It’s not anti-Semitism, but they’re losing money, so they don’t care if they lose these patients,” the billing agent of a major Boro Park practice, who asked not to be named, told Hamodia.
While UHC has serviced thousands in Orthodox centers for decades, the billing agent said that increasing reliance on Urgent Care Centers is a major factor in the change, coupled with UHC’s permissive coverage policies.

Board Approves Plan for a Chasuna Hall

Last  night at the Lakewood Planning board meeting the board approved a extension to Yeshiva Toras Menachem school building on Swarthmore Ave that will include a wedding hall.  In order to have sufficient parking the school leased a adjacent 2.5 acre parcel from the Lakewood industrial commission (LIC) at a cost of 25K a year. Board insisted it be a 50 year lease and use of the hall will be cintingent on the lease.

כאשר השנה מעוברת ומתווסף חודש אדר נוסף ללוח השנה, נדחים כל ענייני חג הפורים לחודש אדר השני, ובניהם קריאת פרשת זכור ומצוות חג הפורים, וחודש אדר הראשון נחשב כחודש רגיל מן המניין. אכן מן הגמרא משמע שאף שהמגילה אינה נקראת בחודש אדר הראשון, מכל מקום עדיין התאריכים יד' וטו' שבאדר הראשון שווים ליד' וטו' שבאדר השני בתענית והספד, וכשם שאסור להספיד ולהתענות בפורים כך יהיה אסור ביד' ובטו' שבאדר הראשון, ומשום כך נוהגים שלא לומר תחנון ונפילת אפיים בימים אלו, שאין זה נכון לומר בהם "יענך ה' ביום צרה", שהרי ימי נס והצלה הם מכל מקום. יש מן הראשונים שכתבו שיש להרבות בסעודה קצת בימים אלו, ואף שלא נהגו כן, מכל מקום אין בכך כל רע, ודבר טוב הוא להרבות בשמחה ומשתה בימים בהם נעשו ניסים לישראל

Shatnez Alert: UGGS

Update: Greaterlakewood.com- Uggs can be worn but should be checked
Due to information that has come to light, NCSTAR (National council of shaatnez testers and researchers) has said that uggs should not be worn even if they were previously tested until further notice. Three is a thorough investigation being performed and an update will be sent out upon completion." The company UGG put out a statement saying all their boots contain linen. Shatnez checkers have not found linen in the places they usually check. Rabbi Sayagh of lakewood shatnez has contacted the company and the company will be contacting the manufacturers. In the meantime Rabbi Sayagh and other Shatnez checkers are opening up UGG boots completely and examining them. They expect to have an answer Monday or Tuesday. Gedolei Yisrael 48 hour visit to Lakewood

The Gedolei Yisroel Harav Ezriel Auerbach shlita and Harav Shmuel Deutch shlita will be coming to Lakewood for 48 hours to raise funds for the united Mosdos of Eretz Yisrael there will be a  community wide gathering tomorrow Tuesday evening at Cheder Bnei Torah at 9:30 pm the full schedule will be made public once its finalized.

Farher season For Local Mesivtas in Lakewood

This year Purim koton is when 8th grade boys graduating elementary begin taking bechinos for Mesivta. There are close to 1100 boys graduating 8th grade this year and most will be going locally to the 40 plus mesivtos in Lakewood. A small percentage of  boys go out of town. On average most bar mitzva boys apply to 3-4 mesivtos due to the high demand to get in. This year there are 6 new mesivtas opening for the coming year in Lakewood.

The crown of Torah Jewry in America. How befitting a choice of Belz to build a community, upon such a foundation. The existing Torah infrastructure certainly supported its success. Despite the many naysayers, that deemed it an impossible feat, Belz is a blossoming community. We are witnessing an unbelievable growth; above and beyond all projections. The growth is evident, not only in numbers but rather, in the values, that have been implemented.
The Belzer community has centered itself as a place for Torah and Tefillah. The Belzer Bais Midrash is a vibrant place of Tefillah, where neighbors of all stripes, gather for davening. As well, the Belzer Kollel, has become a place where the sweet Kol of Torah resonates, constantly. It has become a community Kollel of sorts. Many Choshuver Talmudei Chachamim and Rabbanim from the neighborhood, find their place within these walls.

A perfect setting with access to many Seforim, and of course the enthusiastic Kol Torah of Yungeleit deeply involved in their learning.

Perhaps the most telling, about the Belzer community, is the Rav Chesed organization.

Rosh Yeshiva and wife Removed from Flight on Baseless Accusation

NEW JERSEY - Hamodia.com A Rosh Yeshivah and his wife were forcibly removed from a United Airlines flight in what they claim was a completely baseless and unsubstantiated accusation by a crew manager.
The couple, who are in their mid-70s, boarded a flight at Newark Airport headed to Amsterdam, from which they had planned to continue to Eretz Yisrael for the wedding of a grandson. Upon entering the cabin, the Rebbetzin approached the cabin manager, known as a “purser,” to ask if she could store her sheitel box in an onboard closet, as she had done on many other flights. The request was denied by the purser, whose first name was “Juan.” He replied that there was no room and that the item had to be placed in the overhead bin.

About 20 minutes before the scheduled takeoff time, the purser approached the Rebbetzin and asked that she stow away a different carry-on item in the overhead compartment. When she asked for a moment to remove a few pieces of reading material, the purser abruptly said, “I’m going to get you off this flight.”

Trial Update

-Thursday-   Greaterlakewood Trial Update for R' Eisenman  The prosecution continued testifying, and completed their testimony.  The defense said there was no evidence presented for them to defend and filed a motion to dismiss. The judge then considered the request but ultimately denied the motion.

Marijuana should be legalized in the long term in Lakewood

Image result for Marijuanaso says the mayor. As the state of NJ prepares to legalize weed and Marijuana 60 towns in NJ have passed  ordinances banning the sale of Marijuana. If legalization does happen, these towns would not be able to prevent residents who are at least 21 year old from possessing small amounts of weed and using it in a private residence. But they can prevent marijuana businesses from growing and selling in their limits.    In an interview with the Lakewood shopper , Lakewood mayor Ray Coles was asked about Marijuana if it should be sold in Lakewood. The response was that in the long term it should be legalized but a lot of things have to fall into place. There were some proposals to have a area of medical Marijuana but no licenses were issued read interview below

Jackson Council Condemns Religious Hate

The Mayor of Jackson and Council President  Rob Nixon condemned religious hate, bigotry, stereotyping, scapegoating and an ‘us vs. them’ mentality (see video below). They stressed it is wrong to use children in videos & said it is not what we are about. They stopped short of passing a formal resolution denouncing Rise Up Ocean County. They read a statement "The mayor and council took an oath to defend the Constitution and that includes the right to free speech. At the same time, we do not endorse and are not responsible for the content of the press and social media." APP reports. Mordechai Burnstein, a California Avenue resident said  “I don’t consider the Orthodox community new anymore. I’ve been here almost four years. We are a part and parcel of this community and we’re not going anywhere,“We want to be united. Rise Up Ocean County – a self-described “movement” that began on Facebook about 10 months ago – is calling upon residents of Ocean County to resist efforts of the local Jewish community, particularly in Lakewood, to expand.

The movement, which mainly comprises nine administrators, began when leaders of the group found that county officials were not responding to their concerns, a RUOC representative told The Jewish Press. “We realized that the only way our elected officials would pay attention was if we were louder, with more people speaking up.”

The representative said the group’s goal is rally the public and “do everything in their power to slow and manage the projected growth.” To this end, RUOC plans to release a documentary – “OC 2030” – on February 18 about the deleterious impact it claims the further expansion of the Orthodox community will have.

RUOC consistently denies being anti-Semitic, but many find its Facebook posts and videos unmistakably anti-Jewish. One video, for example features Martin Niemoller’s famous poem “First they came for the socialists…” – which is associated with the Holocaust – over footage of Lakewood Jews. The video urges community members not to be complacent as their land is bought up and to raises their voices before it’s “too late.”

“Any video where the narrator corrupts one of the most widely-recognized Holocaust poems is obviously sending messages that are purposeful in their divisive attitude,” Michael Cohen, East Coast Director of the Wiesenthal Center told the Jewish Press.

Lakewood Fire District Budget Elections This Motzei Shabbos

The Lakewood Fire District Annual Election will be held this Saturday, February 16, 2019,
between the hours of 2:00 p.m. and 10:00 p.m.(or longer if necessary) at the Lakewood township Municipal Building Court Room 231 Third Street, Lakewood, New Jersey.
A vote to approve or reject the annual Budget for this year at  $6,552,535.00 (last year was 6.3 million)

Another vote the  LFD is asking voters to approve the purchase of 2 new fire engines to meet the needs of the residences an amount not to exceed $1,500,000.00. Money will come  through financing or from capital improvement funds.

BOE Reverses Will outsource transportation after purchasing own buses at a loss

It was back in 2016 that the Lakewood BOE under the state monitor decided to purchase its own bus fleet to transport the students to school. At the time they said it was going to be a savings of $3 Million dollars a year. Fast forward 2 years and now it appears that it ended up costing an additional $3 Million dollars a year. The board hired  private auditors that determined they could save about  $8 million over 3 years by outsourcing.  So the board voted to outsource the transportation to private companies for the next 3 years, and sell its fleet of buses. Bus companies Jays and Seman Tov won the contracts.
 BOE members did not approve of the purchase of the buses back in 2016 but were overridden by the state appointed monitor. No word how much money will be recouped from the sale of the district owned and leased buses. Officials said in 3 years they will revisit and decide if to continue with the bids or bring it back in house.

BDE: Harav Shlomo Breslauer Zt"l

Hamodia- With great sadness we report the passing of Harav Shlomo Mordechai Breslauer Zt”l, one of the elder Rabbonim of the Monsey community.

Levaya in Monsey at 4:00pm

Rav Breslauer learned in Bais Medrash Elyon, and was the founder of Beth Tefillah, where he served as Mara D’asra for over fifty years. He was also involved in certifying the kashrus of several food establishments, as well as participating in all community issues.

Many mispallelim, including several gedolei Yisrael, frequented Beth Tefillah due to their serious atmosphere they had for davening and kedushas bais haknesses, which was imbued by Rav Breslauer from the start.

In addition to his rabbanus, Rav Breslauer was a rebbi in Yeshivah of Spring Valley, educating generations of talmidim with his characteristic ehrlichkeit and warmth.

כוח התפילה ביום זה הוא עוצמתי וגדול, בפרט עבור הנשים. עד כדי כך שמסופר עליו על הרבי מבריסק, שכשהיה נכנס לבית הכנסת ביום ז' באדר, היה פונה אל הקהל ואומר: "גברים – נא לצאת, נשים – נא להיכנס". וכשהאולם היה נמלא בנשים, פצח בדרשתו וגילה להן את הכוח העוצמתי שבתפילתן, שבכוחו להשיג את 'ונהפוך הוא' ממש כשם שזכתה אסתר המלכה בשעתה.

State of Emergency declared in New Jersey ahead of Winter Storm

Gov. Phil Murphy on Monday declared a state of emergency, effective midnight, as parts of the state could get hit with up to 8 inches of snow, along with a dangerous mixture of ice and sleet.
Lakewood could get between 1- 3 inches overnight.

 “We’re declaring a state of emergency for the entire state effective midnight tonight," Murphy said in a late afternoon news conference at State Police headquarters, NJ.com reports. The winter storm is expected to hit New Jersey starting Monday night with snowfall totals of 3 to 6 inches for the northern half of the state and the chance for up to 8 inches in some spots.

Assisted Suicide bill advances in Trenton

This past Thursday in Trenton The “Aid in Dying” bill cleared the state Senate Health, Human Services and Senior Citizens Committee in a 6-3 vote following 90 minutes of often tearful, pleading testimony from people who spoke for and against it. New Jersey doctors would be legally permitted to write prescriptions to enable terminally ill patients to end their lives.
A group of frum orthodox Jews along with other Catholic groups were on hand to protest (see video) and urged a 'no' vote to the assisted-suicide bill but were not allowed to speak prior to the vote. The  Excuse was there isn't enough time. The chairman bent the rules so to prevent them from speaking out on a matter of life and death.
 NJ Senator Vin Gopal voted for the bill disappointing many of his constituents.

BOE : All Attendees at Public Meeting Must pass through Metal Detector

Message from Lakewood BOE: It is extremely unfortunate that I must share this message with all of you today; however, due to recent developments, and a frightening attack at Town Hall this past week, the Board of Education now requires that all attendees must pass through a metal detector and/or hand held metal detector wand in order to attend any future Board of Education meetings. 

Metal detectors and metal detector wands are utilized at all Lakewood Public Schools and School events.   The next Board of Education meeting is scheduled for February 12, 2019 at 7:00 p.m.

Rebbitzen Devorah Svei Z”l, the wife of Hagoan Harav Elya Svei Zt”l, passed away today after an illness.
Matzav - Rebbetzin Svei was the wife of Rav Elya Svei zt”l, rosh yeshiva of Yeshiva of Philadelphia, and a daughter of Rav Avrohom Kalmanowitz zt”l, famed Torah pioneer in America and founder of the Mirrer Yeshiva in Brooklyn.  Rebbetzin Svei was a noted mechaneches, who, in addition to serving as a devoted eizer kenegdo to her illustrious husband in his leadership of the American Torah world, educated and inspired generations of bnos Yisroel, being mechanech them b’derech Yisroel saba.

Tehilim for Victims of Bus Crash on way to Yerushalayim

YERUSHALAYIM (Hamodia)- Two ladies from Modiin Illit were killed, and dozens others injured, when a bus overturned on Route 443 after hitting a car, on the way from Modiin Illit to Yerushalayim on Sunday morning.  They were identified as Mrs. Rachel Guttman, a”h, 29, and Mrs. Ruchama Rosen, a”h, 27. Their levayos will be held at 8 p.m. Sunday night, from the main shul of Modiin Ililt on Sdei Chemed St., to Yerushalayim.  Please daven for Chemdatia Ditza bas Rivka; Tamar bas Rivka; and Moshe ben Chanah Hendel, who are hospitalized in serious condition.

Winter Weather Advisory 1-2 Inches of Snow possible tonight

The National Weather Service  has issued a winter weather advisory  for eight counties including Ocean county as New Jersey is bracing for two possible chances for snow over the next few days. The advisory goes into effect from 10 pm tonight into Monday noon. Mixed precipitation expected. Total snow accumulations up to two inches expected and ice accumulations of a light glaze possible.

The advisory is in effect in Ocean, Atlantic, Cape May, Cumberland, Salem, Burlington, Camden and Gloucester counties. Plan on slippery road conditions. The hazardous conditions will likely impact the Monday morning commute.

OCPO Charges Lakewood Stabbing suspect with Attempted Murder

Ocean County Prosecutor Bradley D. Billhimer announced  today that Reginald Patillo, 47, of Lakewood, New Jersey was arrested and charged with Attempted Murder, Aggravated Assault Against a Law Enforcement Officer, Resisting Arrest, Possession of a Weapon for an Unlawful Purpose, and Unlawful Possession of a Weapon. at approximately 11:00 am this morning patillo attacked a Lakewood resident as he entered the 2nd floor elevator in the municipal building. He stabbed the resident multiple times in the neck and head area

Suspect a Lakewood resident (reportedly lives in a nearby mental home)  said to be a Emotionaly Disturbed Person.
Officials  beleive Attack was random not terrorism or race motivated.
GreaterLakewood.com reports A person was stabbed Thursday Morning in the Lakewood Municipal building. Officials confirmed with Greater Lakewood that as the victim exited the elevator he was stabbed in the neck.
An african american male was taken into custody. An official tells GL that the victim, a Jewish male, was bleeding so badly that you could not see his face.
APP.com  Reports a LPD spokesman said the injuries aren't believed to be life threatening. The suspect also struck a police officer in the eye with a closed fist when officers approached him he resisted but then taken into custody. It appeared to be a random attack

The victim was treated at the seen and transported to Jersey Shore Medical Center. His condition is not known at this time.
