Trial Update

-4:25 pm: Fund is being set up to cover cost of a appeal. First lawyers will file motion to dismiss they believe it's on solid ground for a dismissal. If not they will appeal.
-4:00 pm: Summary by Greaterlakewood.com - Defense will file motion to dismiss the case

Summary:

There were 5 counts against R Eisemann and 4 against the foundation.
All 4 against the foundation were dismissed.
Counts 1,2, and 4 against R’ Eisemann, the jury found not guilty. Those were the ‘serious crimes’. Count 3, which the jury said guilty to, was money laundering which the defense says is only possible if one count either 1,2 or 4 is guilty. But since they were not, they are hoping count 3 will be dismissed.
Count 5 is ‘misconduct by a corporate official” – this is only applicable if one other crime was guilty. In addition to a crime – there is mistrust but without a crime, no mistrust took place!
The defense will now file a motion – based on this – to dismiss the case.
As is, this ruling is better than the plea deal that was offered.
There is a possibility the result would only be a monetary compensation…

-3:15: PM Guilty of money laundering and misconduct of public officials,
- NOT guilty of three other charges including the most severe one corruption of public resources he was acquited on the charges of using funds to pay off credit cards and invest in a apparel company.

Sentencing is April 29th 9:00am 2 days after Pesach

-3:10 Jury reached a Verdict

-11:15 am: Jury asks to see document by defense that shows forensic of accounting of the foundation bank account. Judge says jury can't have the record because it only heard testimony on school and not the foundation.

-5:00 pm: One Juror has a job interview tomorrow at noon and asked to be excused. Judge will decide tomorrow if alternate will take over. This alternate heard testimony but didn't participate in deliberations.
- 4:40 pm: Jury dismissed for the day will continue 4th day of deliberations tomorrow morning 9 am.
-4:10 pm: Jury finished listening and continue deliberating
-3:10 pm: Jury will listen to 4 minutes of testimony and 90 minutes of cross examination with an option to skip. Deliberations likely to continue tomorrow
-2:50: pm Jury listening to recordings of testimony.
-2:20 pm: Defense attorneys argue jury can't just listen to half the testimony must listen to defense testimony that no prior approval is needed. Judge says Jury didn't ask and won't hear defense witness again
-2:15 pm: Jury asks follow up question to hear testimony about what state approvals are needed before a school can loan out money.
-12:30 pm: 1 hour Lunch break
-11:30 am: Jury asks for transcript of testimony given by Dep of Education employee during trial that schools can not loan money with out prior permission. Defense witness said it does not apply to individuals. Judge said they can listen to the recording but not read a transcript. Listening will take a few hours if jury opts to hear it.

- 4:20 PM: Deliberations end for the day jury will continue tomorrow morning at 9:00am
-3:55 pm Judge tells jury they have until 4:15 pm to deliberate today if no verdict they will resume tomorrow morning 9am
-3:50 pm Jury has question about alleged value on some charges in the indictment.

-Friday February 22,
3:00 PM- Jury Deliberations end for the day they need more time will resume next week Monday morning 9:00am

-2:35 pm- Jury back deliberating, told that due to religious obligations deliberations will end at 3:00 Pm (app reporter on twitter)
- 2:15 pm-  APP reporter with analysis on Twitter, Jury taking close look at flow of money looking into account were public funds were deposited.
- 12:30 pm Jury taking a hour lunch break.

-Thursday February 21, 2019:

4:30 pm Prosecutors finish closing remarks. Judge will read jury their instructions. Deliberations likely to begin tomorrow.
3:00 pm Prosecutors begin closing arguments
Lee turns to the Jury & says “I am sure you are wondering why they (prosecution) are calling him (R Eisemann) a thief if the victim (Township) said he never stole from us & even called him a ‘secular saint’
2:55 PM Lee was very emotional in his final remarks talking about the school and all the good that goes on there.



His last line is to the jury ‘ I pass the burden to you knowing you will do what is right, just, and fair’
Closing arguments continue after 1:30pm Lunch break.
Lawyer tells Jury you can not trust the state. This was a investigation in search of a crime.



Detective confirmed that if sufficient private donation covered the transactions there is no crime.
Defense attorneys present closing arguments asking jurors to put aside prejudice and bias.  App reporter on Twitter says there are 25 supporters in the courtroom.
