            What is a community’s recourse to prevent nearby development? a Halachic discussion by the
 Bais Havaad Halacha Journal :
-The validity of secular regulation in halacha
-Fighting the development in the township zoning or planning board

Thehalachacenter.org- A quiet, residential neighborhood, a mini-community of seniors to whom a tranquil pace of life is of paramount importance, is facing a threat to its tranquility.

A real-estate developer seeks to establish a monstrous shopping mall directly adjacent to the main entrance to the neighborhood. Emotions run high, the controversy generates daily fodder for the gossip beast, and many outsiders keep their fingers on the pulse, anxious to see how things will play out.

Both the developer and the community are observant Jews. What recourse does this community have according to halacha? Does the developer have the halachic right to develop? In what forum may the community litigate to prevent the development?

Welcome home Yeshiva Bochurim from Eretz Yisrael as they come back for Bein Hazmanim. After spending a year away from home learning in yeshiva the bochurim come back for Pesach. TBL- New agreement signed between Lakewood shopping village and PRV

TBL-After the March 5th agreement signed by PRV there was significant disagreement in PRV as many residents and even members of the board had not been consulted nor had they agreed to the arrangements int he agreement. On March 9th, a meeting open to all PRV residents was held and a public vote was held on a new agreement. The residents voted in favor of the new agreement.

The primary changes in the new agreement are:
1) There will be no entrances to the Shopping Center on Pine Street. The only entrance will be on Ave of the States. The proposed entrance from Cedarbridge (if Vine is not able to be opened) was eliminated. 
2) The PRV association will not only not oppose, but they will actively support an approval.

Frum ads now displaying on Digital Billboard in Lakewood

A local yeshiva is advertising an event on the digital billboard located by stadium at the corner of  cedarbridge and New Hampshire. The billboard is owned by the BlueClaws baseball team. With the township recent approval of 5 more digital boards around Lakewood, this will now be the new norm and another expense on the advertising budget.

Lakewood cheder Directory given out free to residents

A sign of the times the 2017 Lakewood phone directory was distributed free of charge to residents. The Lakewood cheder published the directory as a fundraiser. As technology advances the paper phone book is more obsolete and people rely more on  digital formats such as the smart list. Another factor is people dont have landlines anymore. This created a problem for advertisers since people no longer buy the book, giving it out as a complimentary gift is a smart choice.

Hamodia: Jackson Township Bans Dormitories and Restricts Schools

“This same council has approved mega developments and all the town’s public schools in residential areas, but they’ve been able to convince the public that banning dormitories and schools where students have no cars is the solution. Of course they should address overdevelopment, but this isn’t the way to do it, and it certainly points to some other motivation,” 
 After two emotionally charged public meetings, the Jackson, N.J., town council voted to enact an ordinance that bans the construction of dormitories and places severe limits on the building of all schools. The measure has engendered controversy, as many see it as aimed at curtailing the recent influx of Jewish families as the borders of the neighboring Lakewood community rapidly expand.

The Sefer was donated by mispalelim of the Bais Medrash the procession left from the home of the Skver Dayan of Lakewood Rav Avrohom Chaim Shpitzer, to the shul. Its erev Pesach you scheduled your cleaning lady to come, she doesn't show up. She never missed a day and didn't call in sick. You find out another desperate yiddeneh offered her more money to come clean by her. This is not hypothetical but its actually happening again. People are paying close to $17 an hour for cleaning help taking away cleaning help from the people who have them on a steady basis. Poskim debate the issue if its Assur al pi halacha. However think of the tzaar caused on someone else who is left with no cleaning help forced to work twice as hard, is that the feeling you want going into the Pesach seder?

Many promises were made to the public that never happened. Other reasonable requests were simply ignored. Other decisions were made that simply were not beneficial for our town.

We’re at the point where it’s clear that the Mayor prefers cheap soundbites and really just doesn’t care about promoting new ordinances that would really enhance our quality of life. This June in the primaries and this November in the general election—the residents of Lakewood will have a choice. Committeemen Coles and Delia are both up for re-election. The residents of Lakewood will need to decide if Coles really has our best interests in mind or if he is catering to special interests—to the detriment of everyone else in Lakewood.

City on Edge: Online version Lakewood’s demographic and cultural shift started toward the end of the last century. In 1990, Lakewood had about 45,000 residents; the town was depressed and considered something of a backwater. By 2000, the population had ballooned to more than 60,000. A decade later, the 2010 census reported that 92,843 people called Lakewood home. Today, most township officials put the population closer to 120,000. And with the ongoing increase estimated at 5,000 people per year, they project that by 2030, more than 220,000 people will live within Lakewood’s 25 square miles. Jackson council votes to approve dorm ban

The Jackson council voted to approve an ordnance banning the construction of dormitories in the township. Jackson residents Members of the orthodox community reached out to township officials to discuss the issue and asked to be  Given a chance to sit down with them and work out a compromise but got no response from officials. A council member said prior to the vote this ordinance is not against any race or religion.

Lakewood’s Blizzard That Wasn’t

LAKEWOOD - Despite dire predictions of a blizzard that most felt would surely cancel schools and grind the town to a near-halt, most Lakewood residents had a wet but mostly normal day on Tuesday as shifting weather patterns turned the snowstorm to a heavy rain accompanied by strong winds before dawn.

On similar occasions in the past, when predictions of heavy snow did not pan out, most students in the town were left without busing. On Tuesday, regular transportation for nearly all of the town’s mosdos came as a welcome change.

“I was pleasantly surprised. Not only did my sons have busing, but even the Shacharis bus made its pickups. I’m sure the kids were disappointed not to get the snow day they were waiting for, but it’s much better that they’re learning, and easier for everyone this way. It is certainly not what any of us expected,” said one father.

Christie Slashes private school security funding

New Jersey Governor Chris Christie’s decision on March 15th to eliminate security funding for nonpublic school students has sent shock-waves throughout the private school community. The proposed budget cuts left many observers struggling to comprehend how the governor could leave 150,000 children virtually unprotected during a time when anti-Semitic incidents have skyrocketed to unprecedented levels. 

Township to pass defeated Fire budget by enacting small reduction

Lakewood taxpayers voted down the 2017 fire district budget.  The Township Manager has recommended that the defeated budget of $5,029,295 be
amended by a reduction in expenditures of $10,000 to result in a budget of $5,019,295. In order for the budget to pass after it was voted down there has to be a reduction. The township is expected to pass a resolution that will only took out ten thousand dollars from a budget of over 5 million dollars. Last year after the pubic voted down the budget the township reduced expenditures by $238K. Now they only reduced it by 10K and this comes after asking Tax payers to approve close to 200k for capital improvement projects just after they raised the fire tax from 0.058 to 0.070

Schools tell parents no courtesy busing if you dont pay the $150 fee

Schools sent home notes to parents of non mandated children informing them they must sign up now and pay the $150 per child fee to the LSTA if they want busing next year. The Lakewood Cheder so far has not enforced this and did not bill or charge any of its parents for the $150 fee. As things stand all public school students who are not mandated are receiving courtesy busing free of charge paid for by Lakewood township. Children in Private schools and yeshivos depends which school you go to if they are enforcing the fee. Not clear why the LSTA is using the schools as proxy and not reaching out directly to all private school parents.

Blizzard warning for Ocean county 6-12 inches

The National Weather Service has issued a Blizzard warning for COASTAL OCEAN, EASTERN MONMOUTH, MIDDLESEX, OCEAN and WESTERN MONMOUTH county, effective through TUE at 6:00 PM. Snow totals can be from 6-12 inches depending on mix of snow and rain. "The heavy snow will make many roads impassable and may produce widespread power outages due to the weight of the snow on tree limbs and power lines," The warning also cautions about power outages  "Strong winds will lead to blowing snow, reduced visibility, and additional power outages."

Cheder on Wheels
A new cheder is opening in Lakewood its called "Cheder on Wheels", in Hebrew its called yeshivas אלה ברכב .The concept behind it is very simple,  said a spokesperson for the STLA "its no secret children in Lakewood are spending more time on the bus than in school". Its more practical to just have the Rebbe get on the bus and teach the kids. In some cases, the Rebbe also drives the bus. Lunch will be provided by Pizza on wheels. Parents are thrilled  with this concept and signing up their children, one of the benefits is there is no building fund. Its not an original idea though there has been cheder on wheels even in a building.

 Food for thought is coming to town
 B'H  Lakewood has no shortage of kosher supermarkets, but there is always room for those that have no room. Investors are catering to a niche market of customers who dont feel comfortable shopping with others in regular stores. They have phobias preventing them from shopping in public. The food for thought aisle is geared to those on diets that like to shop but cant bring home the food. The shmiras einayim aisle will make it easy for those who dont look up as the prices and items will be printed on the floor. The Kosher aisle will feature products that have no bugs no yoshon and under the approval from Rabbi Yudel shain these shelves will be empty most of the time.

Investigators hopeful to return cash to rightful owner
A large amount of cash was found this week at 3rd street and Clifton avenue, upon further investigation the money was found sometime right after a  nearby government meeting. It was unclear if the envelope was dropped on the way in to the meeting  or on the way out which will give a clue to who it belongs to.

Levaya will be later this afternoon by the cemetery in queens Shiva will be at 5 fieldcrest drive in Monsey from Monday night until Thursday morning.
Updated: BD"E  R' Peretz Scheinerman Z"l a 58 year old man passed away after he was struck crossing lkwd New Egypt outside  Westgate at the entrance near Cory street.
 He recently moved to lakewood from Monsey  he lived in EY for a while. Police are investigating.   He is survived by his brother Rav Moshe Scheinerman shlita A rav in Flatbush, and his children. TNZBH.

A word about the traffic today in Lakewood

Everyone is texting and messaging each other about the insane gridlock they are experiencing today in Lakewood.
It is certainly understandable that on a pre purim shopping day,that is also a fast day, especially before sabbath there will be traffic.
Last year the traffic was not nearly this bad. A few years before that it was non existent. I just want everyone to understand that the traffic they are experiencing today is what lakewood could be like every dayin the very near future if we don't start to manage our growth responsibly. In order to do that we need elected officials that understand what needs to be done.
Do you think the same people that have been in office all these years or those with the support of the VAAD will try to fix things? What is going to change now that they couldn't do before?

Lakewood not joining Women’s Strike: ‘A Day Without Women’

The social movements continue with a Women’s Strike today‘A Day Without Women’ events  Taking Place Worldwide today March 8th. Some Schools in the US Announced Closings, and Demonstrations are Planned. This comes on the heels of other movements such as the day without immigrant strike. While many Lakewood mothers would appreciate a day off they are not expected to join  in this protest.

Large westgate style development coming to 14th street area

There is no safe place anymore, if developers have their way a new large development will be built on one of the last quiet areas of town. Local residents are outraged, as the area is known to be one of the quietest areas of Lakewood. Nestled among quiet blocks on the Northern shore the lake Carasaljo and GCU it is not zoned for even duplexes! Developers have quietly purchased properties along 14th street adjacent to the college and are in talks with university officials to buy large swaths of land from Forest Avenue stretching along 14th street to Case rd. They plan to parcel off these lots and put up a 500 unit rental development. The eastern entrance will be off Forest Avenue on one side and will come out on Case rd from the other side. Plans are to open up the dead ends along fourteenth street and make them through streets connecting to the proposed development. Some Lakewood residents feel the density in town should be spread equally and not only designated for the south side at Oak street.  As one resident put it "Its time the decision makers get a taste of what the rest of Lakewood goes through on a daily basis".

Jackson Planning board endorses dorm ban

APP reports the Jackson planning board has endorsed the ordnance ban on Dorms. "The crowd of nearly 200 broke into applause after the planning board unanimously endorsed a controversial ordinance that would prohibit the construction of dormitories.  The township is expected to vote next week. "It's normally a matter of routine: Before voting on an ordinance, the township council lets the planning board review and rule whether a proposed land use change is consistent with the master plan — the overarching land use document for any municipality. Now, the township council is expected to vote on the ordinance at its March 14 meeting." APP.comm

Last night the Republican club had the screening of candidates for the Republican position on the ballot in the primaries . Those screening were Harold Herskowitz Mike Delia Aaron Hirsh Moshe Levenburg At last minute Mike Berman decided to screen After votes were tallied and much deliberation, Mike Delia and Mike Berman were chosen to once again run in the Republican primaries We wish them both the best of luck in June. On the Democratic side Ray Coles is also up for reelection.

Litigation about Lkwd township passing faulty zoning changes without notice

As previously reported , for many years the township committee rezoned areas as requested by developers to both allow residential in non residential areas (Industrial park etc) and to allow higher density residential (multifamily, duplex, changing zones). They also changed parts of zones allowing office buildings on County Line, Shopping Centers in Cedarbridge and more.  
While we were originally looking at a list of 20 ordinances from 2005-2015, we've now expanded that list to 50 ordinances from 2005-2016. We are in the process of confirming exactly which ordinances required notice and did not send notice therefore depriving the township committee of jurisdiction to make the zoning change.

Law will have an affect on Chasidic and sephardic Jews

Law Targeting Hasidic Jews?
Our government is looking to further involve themselves in our children’s marriages! A law voted by the NJ and NY assemblies and awaiting a Senate vote would prohibit marriage before the age of 18. Many women in the  Jewish community  marry young, especially in the Syrian and Hasidic circles. The proposed bill read PDF version will make such marriages illegal. We have many happily married couples in our community that attest that this bill will only hurt us. Couples that marry before the age of 18 may  be prosecuted by law. Read Bill HERE

7 Adar a special day

7th of Adar today Sunday (March 5th) was the birth and passing of Moshe Rabainu ע"ה. and also the passing of Ester Hamalka ע"ה.  It is a day that has great segula for prayers. It is worthy to put a lot of effort into the tefillos on this day. It is fitting to light a candle in honor of the 2 tzadikim.
       Particularly to read chapter 22 in tehilim which Ester Hamalka ע"ה wrote when she besceeched Hash-m to flip the Mazel of the Jewish nation. She was a daughter of Rav Eliezer Hamburger shlita from Brooklyn a Talmid Muvhak of Rav Avigdor Miller Zatzal. Shiva is in Lakewood at the Dorfman home 413 13th street.

TBL- Agreement between PRV and Cedarbridge

Pine River Village (PRV) has come to a bad agreement with Cedarbridge and Lakewood Shopping Village (LSV). While Somerset Walk was originally a party to this agreement (and is listed in the draft below), they have since been removed from the final agreement that will be signed today. We will update the agreement here later today once it is signed. 

As Donald Trump would say - this is a terrible deal and we have bad negotiators. While Pine River Village was hoping for many concessions, they were left with a stripped down deal that gave them virtually nothing with minimal guarantees. 

The key points of the agreement are:
a)All stores will be closed on Shabbos
b)Never was and never will be movie theater, ampitheater or playground
c)A 20-25 foot tree buffer will run along Pine St
d)Pine St entrance will be as close as possible to the West side (toward River Ave) and will only be built after Phase II is completed. Right turn out only (toward Route 9) and right turn in only. 3 years after completion they may attempt to add left turns. 

Cedarbridge shopping village up for vote this Tuesday Supposed agreement with Neighbors

APP.com reports that Cedarbridge Development is close to reaching an agreement with residents of Pine River Village, on traffic improvements, and the lawsuit against the township has been dropped. According to the report Barry Hertz, a member of Pine River Village’s homeowners association said  
the homeowners association has been negotiating with Cedarbridge Development Corp., a for-profit arm of Beth Medrash Govoha, the country’s largest yeshiva, for weeks. Hertz said the two sides had reached an impasse around the time the project was pulled from the Planning Board agenda.
